On December 14, 2018, before the coronavirus hit the U.S., plaintiffs filed a class action lawsuit in the U.S. District Court for the Central District of California alleging that the Department of Homeland Security ("DHS") U.S. Immigration and Customs Enforcement ("ICE") and Orange County Sheriff's Department ("OCSD") were preventing them from conferring with their counsel about upcoming immigration proceedings. The plaintiff, represented by the ACLU, requested that the class be defined as all immigration detainees who are now, or in the future will be, detained at detention facilities in Southern California that are owned and operated by OCSD and/or Geo, Inc. ("GEO"). Plaintiffs alleged that defendants had violated the Immigration and Nationality Act ("INA") by making plaintiffs wait in lines to use phones and leave messages for their attorneys during nonbusiness hours, with no reliable way for their counsel to return their calls. As a result, the detainees' counsel had to visit their clients at the Adelanto detention center in person, but the attorneys had no way to schedule their visits in advance and weren't provided with private areas to discuss sensitive case information with their clients, according to the judge's order. On March 24, in response to the coronavirus outbreak, ICE implemented a new policy requiring attorneys to wear masks, gloves and goggles to visit their clients, disregarding the fact that those supplies are in short supply. The case was assigned to District Judge Jesus G. Bernal and Magistrate Judge Shashi H. Kewalramani. 

On October 24, 2019, Judge Bernal ruled on two motions to dismiss, denying the Federal defendant's motion and partly granting GEO's motion to dismiss against a single named plaintiff. Note that the OCSD was dismissed as a defendant earlier in the case after severing their contract with ICE. 

On April 11, 2020, Judge Bernal granted plaintiff's motion for a temporary restraining order. In granting the TRO, Judge Bernal said detainees at Adelanto have shown that they will be irreparably harmed if they are unable to communicate with their counsel about filing petitions to be released from ICE custody amid the novel coronavirus outbreak. Not being able to petition for release could jeopardize the health of detainees who are vulnerable to medical complications from the coronavirus. ICE's argument that the agency shouldn't be held liable for shortages of personal protective equipment was irrelevant. 

Defendants filed their application for reconsideration of the TRO on April 20, 2020. Four days later, Judge Bernal denied defendants' application for reconsideration. In an accompanying order, Judge Bernal converted the TRO into a preliminary injunction. Provisions included: "Defendants shall promptly remove the positive acceptance requirement for telephone numbers provided by Plaintiffs and for any other attorney or legal organization that so requests." "Defendants shall create, implement, and advertise a process by which both attorneys and Adelanto detainees may initiate requests for free confidential telephone calls from the 21 visitation rooms available for that purpose. Defendants should schedule most calls between 8 a.m. and 8 p.m., and attorneys should give Defendants 24 hours’ notice."

On June 23, 2020, defendants appealed to the U.S. Court of Appeals for the Ninth Circuit regarding the TRO and Order on Motion for Reconsideration. No. 20-55647.

On December 28, 2020, district court Judge Bernal stayed the case, vacated the trial and pre-trial dates. Judge Bernal ordered that the matter be stayed in its entirety unless and until the parties returned to court to request a resumption of the lawsuit and to seek a further order governing the timing of the case. The parties were also required to submit a Joint Status Report to this Court by February 1, 2021, advising the Court as to the status of settlement negotiations. 

The Ninth Circuit ordered that the case would continue to be held in abeyance on January 13, 2021. 

On July 13, 2021, Magistrate Judge Kewalramani held a settlement conference between the parties. The contents of the settlement are unclear, but the parties have filed joint status reports near monthly between May 2021 and September 2023.

This case is believed to be ongoing.
