The United States of America brought this action against the State of Georgia and its Secretary of State, Cathy Cox, in 2006, alleging Defendants' violation of 42 U.S.C. Section 1974 b by failing to make available upon written demand the Georgia voter registration list with any social security numbers collected by the state for voter registration purposes, for inspection, reproduction, and coping. The United States sought a declaratory judgment that Defendants were in violation of 42 U.S.C. Section 1974 b and an injunction that Defendants immediately make available for inspection, reproduction, and copying, the requested voter registration records, in electronic format pursuant to 42 U.S.C. Section 1974 b.
Parties reached a settlement, whereby Defendants were enjoined to make available to the United States for inspection, reproduction, and copying, all records and papers relating to voter registration for federal elections, specifically the State's voter registration list, including voters' Social Security numbers, full names, addresses, birth date, and drivers license.
