Case Summary

On November 8, 2006, Plaintiff, who was a candidate in the 2006 Florida gubernatorial election, filed suit in the United States District Court for the Southern District of Florida. Defendants included the Division of Elections and the Secretary of State. The case was assigned to the Honorable Patricia A. Seitz. 

Plaintiff alleged that Plaintiff had sufficient write-in votes to win the 2006 Florida gubernatorial election, but these votes were not counted as part of a ploy by the Florida Division of Elections to rig the election. Plaintiff requested the Court enjoin the commencement of Governor-Elect Charlie Crist’s term. The Court found that Plaintiff’s Complaint lacked an arguable basis in law or fact and Plaintiff failed to state a claim upon which relief could be granted because the alleged facts did not support a cause of action. On November 14, 2006, the Court ordered that the case was dismissed and closed.
