On June 27, 2008, Page County, Virginia filed suit against the United States Department of Justice and the U.S. Attorney General in the United States District Court for the District of Columbia. Page County, Virginia sued the Defendants under Section 4 of the Voting Rights Act of 1965.

Represented by private counsel, Page County sought declaratory relief as a covered jurisdiction subject to the special provisions of the Voting Rights Act, including Section 5, which requires covered jurisdictions to obtain preclearance from either the Court or from the Attorney General for any change in the jurisdiction’s voting standards, practices and procedures.  

Specifically, Page County had previously been designated as a covered jurisdiction subject to the Voting Rights Act’s special provisions because Virginia’s Constitution provided for a literacy test as a prerequisite for citizens to become electors. This literacy test was repealed by the Virginia Constitution of 1972. Therefore, Page County sought exemption from the special provisions of the Voting Rights Act pursuant to the procedure set forth in Section 4 of the Act. 

On August 28, 2008, the parties jointly moved for entry of a consent judgment and decree exempting the County and all government units within the County from the special remedial provisions of the Voting Rights Act.

On September 15, 2008, the three-judge Court granted the parties’ joint motion, and entered a consent judgment and decree exempting Page County from coverage under the special remedial provisions of the Voting Rights Act.
