This lawsuit was filed in the Eastern District of Virginia on December 29, 2005, by a candidate who had lost her election for Norfolk City Treasurer. She filed suit against the members of the Norfolk Electoral Board. This lawsuit was filed in the Eastern District of Virginia on December 29, 2005, by a candidate who had lost her election for Norfolk City Treasurer. She filed suit against the members of the Norfolk Electoral Board. She claimed that her vote had not been counted, the voting machines rigged the results in favor of white candidates, and the voting machines incorrectly counted African-American votes in violation of the Voting Rights Act. The case was assigned to Judge Henry C. Morgan. 

On February 21, 2006, the defendants filed a motion for summary judgment for lack of standing because she only brought the case as a candidate, not a voter. On September 7, 2006, the District Court granted the motion and dismissed the plaintiff's claims.

On October 6, 2006, the plaintiff appealed the ruling to the Fourth Circuit Court of Appeals (Docket No. 06-2086). On March 9, 2007, the Fourth Circuit found that the plaintiff had properly brought the case as a candidate and a voter. However, it affirmed the ruling on modified grounds that the candidate had failed to present any evidence to support her claims.
