This case is about the constitutionality of Florida's Ballot Order Statute (Fla. Stat. 101.151(3)(a)) (the "Statute"), which requires that the first candidate for every race be of the same party as the Florida Governor. On May 24, 2018, three Florida voters, the Democratic National Committee, Democratic Senatorial Campaign Committee, Democratic Congressional Campaign Committee, Democratic Governors Association, and the Democratic Legislative Campaign Committee filed this lawsuit in the United States District Court for the Northern District of Florida. The Plaintiffs sued the Florida Secretary of State under the First Amendment and Equal Protection Clause of the Fourteenth Amendment to the United State Constitution. Represented by private counsel, the Plaintiffs sought a declaratory judgment that the Statute was unconstitutional and preliminary and permanent injunctive relief barring the Secretary of State from implementing or enforcing the Statute. In their suit, the Plaintiffs claimed that the Statute was both an undue burden on the right to vote and represented disparate treatment of the Democratic Party, its candidates, and its supporters. 

On June 19, 2018, the Defendant Secretary of State moved to dismiss the case, first arguing the equitable defense of laches, claiming that it barred the Plaintiffs from challenging the State's nearly 67-year old Ballot Order Statute. The Defendant also argued that the Plaintiffs had failed to state a claim on either of their counts, principally because Plaintiff's purported "position bias" (a statistical theory that a candidate at the top of a list of candidates receives a statistically significant advantage than those listed lower on the list) did not constitute an undue burden on Plaintiff's constitutional rights and that the Ballot Order Statute did not have a disparate impact because it had been passed by a Florida legislature controlled by the Democratic Party, and, since the Statute's passage, there had been more Democratic Florida Governors than there had been Republican Governors. The Defendant also argued that, even if there was a disparate treatment, it was outweighed by Florida's compelling interest to (1) develop comprehensible ballots to avoid voter confusion and (2) streamline the ability for voters to engage in "straight party voting". 

On June 21, 2018, the National Republican Senatorial Committee, Republican Governors Association filed a motion to intervene. The motion was granted on July 1. 

On June 29, 2018, the Plaintiffs moved for a preliminary injunction to enjoin the Defendant from implementing or enforcing the Ballot Order Statute. The motion to intervene was granted on July 1 and, on July 3, the intervenors filed a motion to dismiss. 

On July 24, 2018, following a hearing, the Court entered a minute entry denying the Secretary of State and the intervenors' Motions to Dismiss, as well as the Plaintiff's Motion for Preliminary Injunction as Plaintiffs had not demonstrated irreparable harm.

On April 8, 2019, the Plaintiffs and Defendant filed their respective motions for summary judgment.

On May 13, 2019, after full briefing, the District Court denied each of the motions for summary judgment. In so doing, the Court found that the Defendant's arguments regarding justiciability, laches, standing, and the applicable statute of limitations were unpersuasive. The Court also found that the Anderson-Burdick balancing test (which requires courts to weigh burdens that a state imposes on electoral participation against the state’s asserted benefits) applied with respect to the merits and that there were material issues of disputed fact regarding "position bias" and its purported effects on Florida elections as well as the viability of alternatives to the Statute. 

From July 15 - 17, 2019, Chief Judge Mark E. Walker of the United States District Court for the Northern District of Florida held a bench trial on the issue of the Statute's constitutionality. 

On November 15, 2019, following the three-day bench trial, Chief Judge Walker issued an opinion finding in favor of the Plaintiffs holding that they were entitled to a permanent injunction against enforcement of application of the Ballot Order Statute. In so ruling, the District Court held that Plaintiffs' claims were justiciable as (1) a violation of the Equal Protection Clause and not a political question, as alleged by the Secretary of State and Defendant-Intervenors; and (2) the Plaintiffs had demonstrated they suffered an injury in fact, as required for standing. The Court also denied the Defendant's statute of limitations argument finding that the Statute applied each time there was an election, thus the prior election (which had occurred two years prior) was within the four-year statute of limitations. The Court also held that the doctrine of laches did not bar Plaintiffs' claims because, in the Court's view, Plaintiffs had not inexcusably delayed bringing their claims, as they sought prospective relief from application of the law in future elections, and even assuming that Plaintiffs had delayed without valid excuse, there was no undue prejudice to the Defendants. The Court also found that the Plaintiffs were not constitutionally estopped from pursuing their claims since the Democratic Party candidates were not enjoying any advantage or benefit as result of Florida's ballot scheme at present. Finally, the Court found that the Ballot Order Statute violated the First and Fourteenth Amendments in that Florida advanced no legitimate state interest for favoring a ballot order scheme that systematically advantaged candidates of one party and disadvantaged candidates of another party to statistically significant and potentially outcome-determinative degree over the multiple available alternatives.

Also on November 15, 2019, following the District Court's Order, the Defendant appealed to the United States Court of Appeals for the 11th Circuit (Case No. 19-14621-J). 

On November 18, 2019, the Defendant sought a stay of the District Court's injunction pending the appeal. 

Following a hearing, on November 26, 2019, the District Court denied the Defendant's Motion for Stay finding that the Secretary of State was unlikely to prevail on the merits, would not suffer irreparable harm if a stay was not issued, that the Plaintiffs would suffer irreparable harm if the stay was issued, and that the public interest of holding elections which conform with the Constitution weighs against the issuance of a stay. 

On September 3, 2020, the 11th Circuit, on appeal, vacated the District Court's opinion and remanded the case with instructions to dismiss for lack of jurisdiction. In so doing, the 11th Circuit held that the Plaintiffs had not proven an injury-in-fact as required for Article III standing in that the voters had failed to show that they were disadvantaged as an individual through partisan vote dilution. The 11th Circuit also found that the organizational Plaintiffs lacked standing in that Plaintiff Democratic National Committee ("DNC") had not proven that it had associational standing in that it could not identify at least one member who would be injured by the challenged statute and that the other organizational Plaintiffs failed to demonstrate an injury-in-fact in that they could not identify what activities their resources would be diverted to. The 11th Circuit held that: (1) any alleged injury was not fairly traceable to the Secretary of State; (2) the alleged injury would not be redressed by declaratory or injunctive relief against the Secretary of State as it is the nonparty county supervisors of elections, rather than the Secretary, who have responsibility for placing candidates on the ballot and the supervisors were not subject to the Secretary's control; and (3) the alleged injury was a nonjusticiable political question. 

On November 9, 2020, the District Court, pursuant to the 11th Circuit's instructions, dismissed the Plaintiff's claims for lack of jurisdiction. The same day, the clerk closed the case.
