This is a FOIA case wherein plaintiffs sought records from the Customs and Border Protection pertaining to its Tactical Terrorism Response Teams (TTRTs). 

On December 12, 2019, Creating Law Enforcement Accountability and Responsibility Project (“CLEAR”), the American Civil Liberties Union (“ACLU”), and the American Civil Liberties Union Foundation (“ACLUF”) sued the U.S. Customs and Border Protection (“CBP”) in the United States District Court for the Eastern District of New York. Plaintiffs sued under the Freedom of Information Act (“FOIA”), seeking the release of records pertaining to its Tactical Terrorism Response Teams (“TTRTs”) due to concerns of unconstitutionality. 

Plaintiffs alleged that information available indicated TTRTs may target travelers, including US citizens, who did not post a security risk, and sought to target and deny entry to foreign travelers holding valid documents and not otherwise identified as a security risk. Represented by the ACLU, plaintiffs brought suit to enforce their request for records on TTRTs operations and safeguards to prevent abuse and protect rights under the Freedom of Information Act.

The case was assigned to Judge I. Leo Glasser, and a month later, reassigned to Judge Eric R. Komittee. 

The court set July 31, 2020 as a deadline for CBP to complete its search, processing, and production of responsive records, and gave them until mid-August to provide plaintiffs with an index identifying records it had withheld (Vaughn Index). Court requested a joint statute report by September 2020 on how they intended to proceed.

On February 21, 2021, following an extension of time, CBP submitted a motion for summary judgment, asserting FOIA Exemption 7(E) to withhold law enforcement techniques and procedures that would allow bad actors to circumvent CBP efforts. On the same day, the plaintiffs submitted a cross-motion for summary judgment. The court set a date for oral arguments in mid-April. After arguments, the court exercised its discretion to conduct in camera review of a representative sample of the challenged documents, totalling 170 pages.

Following the review, the court granted in part and denied in part the parties’ motions for summary judgment on March 31, 2022, issuing its memorandum on the order in November of the same year. The court granted the plaintiffs’ cross motion on the adequacy of CBP’s Vaughn Index, but granted CBP’s motion on the propriety of invoking FOIA Exemptions to withhold information. In conclusion, the court directed CBP to release all non-exempt and segregable information, submit an amended or supplemental index, and/or declaration that adequately establishes its Exemption claims, and provide reasonably segregable analysis. 

At a telephone conference on March 7, 2023, the court directed parties to submit either a status report or stipulation of dismissal by May 12. Following three status reports, CBP submitted a proposed stipulation and order of dismissal to the court on August 25, 2023. On August 28, 2023, the court dismissed the case with prejudice, and ordered CBP to pay the plaintiffs $120,000 in attorneys fees and costs. This case is now closed.

MEMORANDUM AND ORDER re 32 & 41 Motions for Summary Judgment. For the reasons set forth herein, both parties' motions for summary judgment are granted in part and denied in part without prejudice. With respect to the adequacy of the Va ughn index and declaration, Plaintiffs' cross-motion is granted and Defendant's motion is denied. With respect to the propriety of invoking FOIA Exemptions to withhold information, Defendant's motion is granted, and Plaintiffs' ; motion is denied for records withheld under Exemption 7(E) and reviewed in camera, pending the release of segregable non-exempt information and submission of a segregability analysis, as detailed herein. The Court reserves judgment insofar a s documents that were withheld under Exemptions 3 and 7(E) but not reviewed in camera. Lastly, with respect to whether non-exempt information was reasonably segregated and released, the Court reserves judgment.Defendant is directed to relea se all non-exempt and segregable information, submit an amended or supplemental Vaughn index and/or declaration that adequately establishes its Exemption 3 and 7(E) claims, and provide a reasonably specific segregability analysis. The segregab ilty analysis must address all documents challenged in Plaintiffs' cross-motion, provide a detailed description of withheld information, and explain how non-exempt material is dispersed throughout each document. These must be submitted by December 16, 2022. The Court will hold a telephone conference to discuss further proceedings on December 27, 2022, at 12:00 P.M.Ordered by Magistrate Judge Ramon E.
