This is a case about delays in receiving Supplemental Nutrition Assistance Program (SNAP) benefits in Washington, DC.

On August 28, 2017, four recipients of the SNAP and Bread for the City, a nonprofit  that provides  safety-net support to the District of Columbia’s low-income community, filed a class action lawsuit in the U.S. District Court for the District of Columbia. The plaintiffs filed suit against the  Director of the District of Columbia Department of Human Services (DHS) alleging the plaintiffs’ SNAP recipients' benefits were wrongfully suspended, delayed, or terminated. The plaintiffs were represented by the Legal Aid Society of the District of Columbia, National Center for Law and Economic Justice, and Hogan Lovells.

For Count I, the plaintiffs alleged the defendant’s failure to process initial SNAP applications and provide benefits to eligible households within seven or 30 days of the date of application violated 7 U.S.C. § 2020(e)(3), (9), under 42 U.S.C. § 1983.  For Count II, the plaintiffs alleged the defendant’s actions violated 7 U.S.C. § 2020(e)(4) under 42 U.S.C. § 1983 because of their failure to allow SNAP households to complete the SNAP recertification application process in time to receive benefits for the new certification period and to determine such households’ eligibility within the required timeframes. For Count III, the plaintiffs alleged the defendant’s actions violated 7 U.S.C. § 2020(e)(10) and the Due Process Clause of the Fourteenth Amendment under 42 U.S.C. § 1983 because of their failure to provide written notice and an opportunity to request a fair hearing to SNAP applicants whose applications the defendant did not process within the mandated timeframes.

The plaintiff requested a declaratory judgement, a preliminary and permanent injunction to “(1) process SNAP applications, determine applicant households’ eligibility, and issue SNAP benefits to eligible households within the mandated timeframes; (2) provide SNAP recipients the right to re-apply and complete the recertification application process in time to receive benefits for the next certification period and determine eligibility and issue benefits within the mandated timeframes; and (3) provide written notice and opportunity to request a fair hearing to SNAP applicants, including recertification applicants, whose applications are not processed within the mandated timeframes”, and litigation costs and attorney’s fees. 

They also requested to certify two classes: first, a class of  “all District of Columbia residents, since June 1, 2016: (1) who have applied, are applying, or will apply for SNAP benefits through an initial or recertification application; and (2) who have had or will have the processing of such application delayed beyond the timeframes mandated by law;”  and second, a class of “all District of Columbia SNAP recipients, since June 1, 2016: (1) who have been or will be required to submit a recertification application to maintain SNAP benefits; (2) as to whom Defendant has failed or will fail to issue notice of the need to recertify; and (3) who have been or will be terminated from participation in SNAP due to Defendant’s failure to issue such notice.”

The case was assigned to District Judge Christopher R. Cooper.

On September 12, 2017, the defendant requested the deadlines to oppose class certification and to respond to the complaint be stayed until the resolution of plaintiffs’ forthcoming motion for preliminary injunction. This was granted by the court on September 15, 2017.

The same day, the plaintiffs filed a motion for preliminary injunction “enjoining Defendant from failing or refusing to: (1) process initial and recertification applications for SNAP and provide SNAP benefits to eligible households in a timely manner; (2) provide the opportunity for SNAP recipients to complete the recertification process and have SNAP benefits for the new certification period issued in a timely manner; and (3) send written notice of processing delays and of the opportunity for an administrative hearing to households subject to Defendant’s delayed initial and recertification application processing.” The named plaintiffs argued they would suffer an irreparable injury by being deprived SNAP benefits and because they have been deprived of their right to notice. Plaintiff Bread for the City argued it would suffer irreparable injury because the defendant’s actions deplete its already scarce resources to serve individuals unlawfully deprived of SNAP benefits.

The plaintiffs filed an amended complaint on October 13, 2017, which added three named plaintiff who were also SNAP recipients or applicants.

On March 28, 2018, the court granted the plaintiff’s motion for class certification. The court approved three classes: First, “all District of Columbia residents since June 1, 2016: (1) who have applied, are applying, or will apply for SNAP benefits, through an initial application; and (2) who have had or will have the processing of such application delayed beyond the timeframes mandated by law.” Second, “all District of Columbia residents since June 1, 2016: (1) who have applied, are applying, or will apply for SNAP benefits, through a recertification application; and (2) who have had or will have the processing of such application delayed beyond the timeframes mandated by law.” Third, “all District of Columbia SNAP recipients since June 1, 2016: (1) who have been or will be required to submit a recertification application to maintain SNAP benefits; (2) as to whom the Defendant has failed or will fail to issue notice of the need to recertify; and (3) who have been or will be terminated from participation in SNAP due to Defendant’s failure to issue such notice.”

The court granted in part and denied in part the plaintiffs’ request for preliminary injunction on May 31, 2028. The court issued an injunction requiring the defendant to process SNAP recertification applications within the statutory deadlines, but it declined to issue an injunction regarding the certification of new applications because it found the defendant was making progress on the processing of initial applications. To support this, the court required the defendant to file periodic reports regarding the status of the corrective action plan and update the court on its timeliness rates. Further, the court found that there was not enough evidence of a systemic failure to require the defendant to provide an opportunity for SNAP benefit recipients to complete the recertification process without a break in benefits, nor to require the defendant to send written notice of processing delays, as the plaintiff had sought.

The defendants filed a motion to dismiss on July 17, 2018. First, they argued that the plaintiffs lacked standing because the alleged injury-in-fact did not exist, as plaintiffs received every benefit authorized under the SNAP Act, and some of the delays were the fault of the beneficiaries. Second, the defendant argued that the Plaintiff Bread for the City lacked organizational standing because the diversion of resources was insufficient to support the claim and the diversion results from the plaintiffs’ choices. Second, the defendant argued that the SNAP Act does not provide a private right of action. Further, the defendant argued the court should reject the plaintiffs’ claims because they relied on inaccurate data and isolated software problems, rather than a systemic failure. Third, the defendant claimed that the plaintiffs failed to state a due process claim under the Fifth Amendment because problems with notifications were isolated and fixed. Fourth, the defendant argued that the plaintiffs could not establish municipal liability under 42 U.S.C. § 1983 because while the plaintiffs alleged a policy of failing to provide written notice to SNAP applicants, there was no evidence of a systemic failure. Finally, the defendant argued that the Fourteenth Amendment did not apply to the District of Columbia.

On August 23, 2018, the court filed an opinion granting in part the defendant’s motion to dismiss. The court kept Count I and II because the named plaintiffs had standing at the time the complaint was filed. For Count III, the court found the plaintiffs did not adequately allege standing because they failed to identify an actual injury traceable to the defendant’s actions.

On January 22, 2020, the plaintiff Bread for the City filed a motion for summary judgment. The document is under seal, and details are unavailable to the Clearinghouse. 

On March 13, 2020, the defendant filed a cross motion for summary judgement. The defendant argued that over the past year and half, it had demonstrated a timeliness and notice pass rate of above 95%. Further, any imperfections in the defendant’s administration of SNAP were under ongoing oversight by the Food and Nutrition Service (FNS) of the United States Department of Agriculture.

On August 19, 2020, the court modified the preliminary injunction, temporarily suspending the defendant’s required monthly reports through the summer of 2020. 

On September 9, 2020, the court issued an opinion denying the plaintiffs’ motion for summary judgement, granting the defendant’s cross-motion for summary judgement, and vacating the court’s preliminary injunction. The court found that while the plaintiff Bread for the City had standing to sue because of the resources it spent on helping applicants and beneficiaries of SNAP, the plaintiffs failed to show that the defendant’s delays came from an official policy or custom. Moreover, the defendant showed compliance with close to 95% of application deadlines, meaning that any delays were not systemic in nature.

The plaintiffs filed a sealed motion for reconsideration on October 7, 2020. Details of the motion were not available to the Clearinghouse. The court issued an opinion on June 11, 2021, denying the motion because the court found that there was no clear error or change in law. First, the court rejected the plaintiffs’ argument that the court should not have considered evidence of the defendant’s actions after the lawsuit was filed, as the court found the plaintiffs had also relied on the evidence created after the complaint. Second, while the plaintiffs argued that the court made inferences in favor of the defendant when using the compliance data, the court found it was conservative in its estimate of the defendant’s compliance that was favorable to the plaintiffs. Third, while plaintiffs raised a Monell liability argument in their motion for reconsideration, the court found the plaintiffs waived this argument because they did not raise it earlier. Finally, the court found that Monell liability was applicable to the defendant because D.C. is treated as a municipality under section 1983.

The plaintiffs filed an appeal (Case Number 21-7068) on June 25, 2021, to the DC Circuit Court. The parties filed a joint motion to suspend the appeal on September 10, 2021, as the parties engaged in settlement negotiations.

On May 5, 2023, the parties filed a joint motion notifying the court of a settlement. The motion was granted by the court on May 9, 2023. On August 17, 2023, the parties filed a motion for preliminary approval of a class action settlement. The parties agreed that the defendant would share information about timeliness metrics from the Food and Nutrition Service, publish quarterly performance reports online, and provide monthly updates to the plaintiffs’ counsel for 3 years. The defendant also agreed to pay up to $500,000 in attorneys’ fees for the plaintiffs. The settlement received final approval from the court on January 18, 2024. On April 1, 2024, the Circuit Court approved the motion to dismiss the appeal. 

This case is now closed.

MINUTE ORDER granting in part and denying in part 18 Defendant's Motion to Stay and for Extension of Time. The Court will grant Defendant's unopposed request to stay the deadline for its response to Plaintiffs' complaint pending the Court's ruling on Plaintiffs' forthcoming motion for a preliminary injunction. However, the Court will deny Defendant's request to suspend the briefing on class certification. The Court doubts its authority to grant a class-wide preliminary injunction - which it appears Plaintiffs intend to request - without first at least provisionally certifying a class. See, e.g., Brown v. Trustees of Boston Univ., 891 F.2d 337, 361 (1st Cir. 1989) ("Ordinarily, classwide relief, such as the injunction here which prohibits sex discrimination against the class of Boston University faculty, is appropriate only where there is a properly certified class."); Zepeda v. U.S. Immigration & Naturalization Serv., 753 F.2d 719, 728 n.1 (9th Cir. 1983) ("Without a properly certified class, a court cannot grant relief on a class-wide basis."); Davis v. Romney, 490 F.2d 1360, 1366 (3d Cir. 1974) ("Relief cannot be granted to a class before an order has been entered determining that class treatment is proper."); cf. Dorfmann v. Boozer, 414 F.2d 1168, 1171 n.8 (D.C. Cir. 1969) ("The preliminary injunction, especially one that worked a transfer of money belonging to persons who were not within the jurisdiction of the court, should not have been issued before the action was certified as a class action."). Given these doubts, the Court believes that briefing on class certification is not wholly separate from the preliminary injunction briefing and may, in fact, be necessary to resolving the preliminary injunction motion. Defendant shall file an opposition to both Plaintiffs' motion for class certification and their forthcoming motion for a preliminary injunction 30 days after the forthcoming motion for a preliminary injunction is filed.
