 On March 13, 2003, defendant (also petitioner) was arrested and subsequently indicted by the U.S. government for distribution of heroin and possession with intent to distribute 50g of crack cocaine. Initially, on March 21, 2003, defendant plead not guilty. But on January 9, 2004, defendant changed his plea to guilty on one count of heroin distribution. On April 25, 2006, petitioner filed a motion to vacate, set aside or correct his sentence pursuant to 28 U.S.C. § 2255, arguing ineffective assistance of counsel under the Sixth Amendment. He filed a pro se petition for a writ of habeas corpus contending that he was denied his Sixth Amendment right to the effective assistance of counsel. This motion was filed in the U.S. District Court for the Northern District of Illinois. In his motion, Petitioner argued that he was entitled to relief because he did not receive a fair trial due to ineffective legal assistance. Petitioner asserted that this was a violation of his sixth amendment rights. According to petitioner, counsel told him that if he were to plead guilty to Count Three of the indictment, he would receive only 18 months imprisonment, and instead he received 97 months. Furthermore, petitioner contends that counsel failed to look into the Statutory Mandatory Minimum Sentence, and if they had, they would have been able to object to the drug quantity calculation listed in the presentence investigation report and demonstrated that plaintiff was entitled to a lesser prison sentence than the one he received. Lastly, defendant argued that he was denied his constitutional right to effective counsel because the U.S. Government had not notified petitioner of his right to consult with the Nigerian Consulate as required by the Vienna Convention, and petitioner's counsel had not claimed a remedy for him based on the U.S. Government's failure. This case was presided over by Judge Charles P. Kocoras. 

On September 7, 2006, respondent filed a response to petitioner's motion, arguing that the court should deny the motion.  Respondent argued that petitioner's motion failed to support a claim of ineffective assistance for the following reasons: (1) petitioner's claim that counsel promised him a lower sentence did not support a claim of ineffective assistance; (2) petitioner's counsel did object to the drug quantity calculation; (3) petitioner's Vienna convention allegations did not constitute ineffective assistance. 

On December 13, 2006, the district court denied petitioner's motion to vacate, correct, or set aside his sentence pursuant to 28 U.S.C. § 2255, denying plaintiff an evidentiary hearing. The court responded to the three issues for review raised in the motion. The first issue raised was that petitioner received ineffective assistance of counsel during plea negotiations. The court stated that this claim contradicted petitioner's sworn testimony, and his base assertion that he was promised a specific sentence by his attorney was insufficient to rebut the presumptive truth of his contrary statement that he received no promises regarding his sentence. The second issue the court addressed was regarding legal assistance during petitioner's drug quantity calculation. The court stated that petitioner's counsel did challenge the drug calculation during sentencing, contrary to petitioner's statements. The third issue raised by petitioner that the court replied to was petitioner's claim concerning the Vienna Convention. The court stated that even if there was a violation of the Vienna Convention, the Seventh Circuit had not addressed whether dismissal of an indictment was an available remedy, but it had unequivocally refused to recognize suppression of evidence as a remedy. Additionally, failing to raise an argument likely to fail was not professionally incompetent behavior, therefore this third ground did not support granting the requested relief. 

On January 4, 2007, petitioner appealed the district court's decision to the Seventh Circuit Court of Appeals, filing a pro se application. The circuit court stated that petitioner alleged a recognized and undisputed violation of rights, asserting that the Government denied him consular assistance and his attorneys did not seek to remedy this issue. On May 22, 2007, the court of appeals issued a certificate of appealability to petitioner, finding that the petitioner had made at least a substantial showing of the denial of a constitutional under the Sixth Amendment, and thus he was entitled to an evidentiary hearing. The court stated that petitioner's counsel should have known to advise petitioner of his right to consular access and to raise the issue with the presiding judge. The Seventh Circuit remanded this case to the district court to decide whether Article 36 of the Vienna Convention had been violated and whether petitioner was prejudiced by the failure to invoke the Convention. 

On November 10, 2009, the district court held a hearing to determine this issue. During this hearing, the court heard conflicting testimony from petitioner, petitioner's former counsel, and petitioner's brother. Petitioner's counsel stated she was aware of the Vienna Convention, and she advised plaintiff of his consular rights, but he refused consular assistance. She stated that due to this she did not raise the issue with the presiding judge. The court found her testimony credible, and concluded that counsel provided adequate legal representation. Thus, the court denied petitioner's motion to vacate the sentence. The case is closed.
