This case concerns a public obstruction statute and police practices in the District of Columbia. On August 8, 2015, the D.C. Metropolitan Police Department (“MPD”) arrested a young Black man under D.C. Code § 22-1307 (“Statute”). The Statute criminalizes “crowding, obstructing, or incommoding” public streets and sidewalks.


On September 14, 2017, a young Black male individual brought a class action suit against the District of Columbia under 42 U.S.C. § 1983. He alleged that the MPD violated the Fourth Amendment by arresting him and having him prosecuted without probable cause. He also claimed the Statute was unconstitutionally vague in violation of the Fifth Amendment’s Due Process Clause because it encouraged arbitrary and discriminatory enforcement and did not place ordinary people on notice of what it criminalized. The named plaintiff sought class certification, injunctive and declaratory relief, damages, and attorneys’ fees. He filed suit in the United States District Court for the District of Columbia. The case was assigned to District Judge Amy Berman Jackson.


On September 15, 2017, Judge Jackson issued a notice of a related class action suit involving the Statute, Agnew v. Gov’t of District of Columbia, 263 F. Supp. 3d 89 (D.D.C. 2017). The plaintiffs in Agnew appealed the District Court’s judgment against them on July 27, 2017. Given the similar factual circumstances and legal questions in Agnew, Judge Jackson stayed the litigation in this case pending the outcome of the Agnew appeal. After the Agnew plaintiffs lost their appeal, Judge Jackson ordered the named plaintiff in this case to file an amended complaint that eliminated the claims now barred by the Agnew decision.


The named plaintiff filed an amended complaint on July 8, 2019, which added a claim that the District of Columbia had violated the Fifth Amendment’s equal protection provision by enforcing the Statute in a racially discriminatory manner. The District of Columbia moved to dismiss the amended complaint on August 23, 2019. Judge Jackson dismissed the challenges under the discriminatory enforcement and due process prongs of the vagueness doctrine  on July 1, 2020, holding that the D.C. Circuit’s decision in Agnew barred any vagueness claims against the Statute. The Fourth Amendment and equal protection claims remained intact. 


On January 18, 2022, Judge Jackson stayed the litigation and referred the case to mediation. She extended the mediation period several times, and the parties filed more than ten joint status reports throughout 2022. The parties jointly moved for preliminary approval of a settlement agreement on December 9, 2022. The proposed settlement agreement provided that the named plaintiff would permanently dismiss his claims and allocated $290,000 for the class fund (with the named plaintiff receiving an additional $5,000), $130,000 for attorneys’ fees, and $25,000 for the cost of administering the funds. The court preliminarily approved this agreement on December 23, 2022.


The parties jointly moved to modify the preliminary approval order on February 22, 2023. The court issued an amended preliminary approval order on February 23, which preliminarily approved the class certification and the terms of the settlement agreement. The court issued final approval of the class action settlement on July 24, 2023, and directed the Clerk of the Court to close the case. The Class Administrator made the last payment to class members on September 6, 2023. As of October 31, 2023, the case was closed.
