On July 18, 2018, plaintiff, a Virginia inmate proceeding pro se, filed a lawsuit in the U.S. District Court for the Western District of Virginia against officials from the Virginia Department of Corrections and Red Onion State Prison. This case was assigned to Judge Michael F. Urbanski. Plaintiff alleged unconstitutional conditions of confinement at Red Onion State prison and he also claimed judicial corruption existed based on unfavorable rulings against him. Plaintiff sought declaratory and injunctive relief, as well as monetary damages.
On November 2, 2018, the district court dismissed this case stating that it was frivolous and malicious, and the court allowed plaintiff 15 days to oppose a prefiling objection. Plaintiff objected this dismissal order and filed a Notice of Appeal to the Fourth Circuit Court of Appeals on November 16, 2018. On December 26, 2018, plaintiff filed a motion filed a motion to seal, which was denied on January 11, 2019. Plaintiff then filed a Notice of Appeal regarding this denial on January 17, 2019. He then filed a second Motion to Seal, which was also denied on January 30, 2019.
On March 26, 2019, the Fourth Circuit dismissed the second appeal for failure to prosecute, and issued a Mandate. On April 22, 2019, the Fourth Circuit consolidated several of Meyers' appeals, including case numbers 19-6173, 19-6174, 19-6175, and 19-6182. On May 8, 2019, the Fourth Circuit denied Meyers' petition for rehearing and motion to reconsider. Plaintiff filed another Notice of Appeal on June 24, 2019. On August 26, 2019, the Court of Appeals dismissed the appeal for lack of jurisdiction.
