Order on Motion for Extension of Time to File Response/Reply

MINUTE ORDER: The Court is in receipt of Defendants' 30 Motion to Extend Defendants' Deadline to respond to Complaint. Defendants request that the Court extend the deadline to respond to Plaintiffs' complaint from October 13, 2023 to November 17, 2023, in order to further consult with agency counsel in advance of a forthcoming motion to dismiss. Defendants also request, on behalf of Plaintiffs, that the Court stay the deadline for a motion to certify Plaintiffs' proposed class until after the Court's resolution of the forthcoming motion to dismiss. Plaintiffs consent to these first two requests, but also move the Court to set an initial scheduling conference for sometime shortly after Defendants file their motion to dismiss. As a rule, the Court does not hold an initial scheduling conference until after the resolution of a Rule 12 motion, and it will not depart from that default practice here. Accordingly, and upon good cause shown, Defendants' 30 Motion to Extend Defendants' Deadline to respond to Complaint is GRANTED. Defendants shall file their motion to dismiss on or before November 27, 2023, Plaintiffs shall file their opposition on or before December 29, 2023, and Defendants shall file their reply on or before January 16, 2024.
