In this case a protection and advocacy agency (P&A) represented a student with a disability who sought to bring her service animal to school.

On September 3, 2021, Disability Rights Pennsylvania (PA) filed this lawsuit on behalf of a disabled student who sought to bring their service animal into school in the U.S. District Court for the Eastern District of Pennsylvania. Plaintiff alleged that the defendant violated Section 504 and Title II of the ADA by refusing to allow the student to attend school with her service animal. The case was presided over by judge Joseph Leeson.

This lawsuit began when the Saucon Valley School District refused to allow a student to attend school with her service animal. They would only allow her to attend school by herself. Because of the school district's refusal, the student did not attend school and was given five hours of virtual tutoring per week.

On September 3, 2021, plaintiff filed a motion for a temporary restraining order, which was denied on September 8, 2021.

On October 12, 2021, plaintiff filed a motion for a preliminary injunction, seeking an injunction requiring the school district to admit the student with her service animal throughout the pendency of the lawsuit. This motion was granted on November 18, 2021.

The parties entered into a settlement agreement on March 25, 2022, requiring the district to continue to allow the student to attend school with her service animal, paying $30,000 to the plaintiffs and $65,000 in attorneys’ fees to plaintiff.

The case is now closed.
