This is a case about a protection and advocacy (P&A) agency’s lawsuit seeking applied behavioral analysis (ABA) for students with disabilities in Hawai’i. The lawsuit alleged that the Hawaii Department of Education and the Department of Human Services failed to ensure that students who needed ABA during the school day were not receiving this service due to the state agencies' policies and practices.

On November 28, 2018, the Hawai’i Disability Rights Center (HRDC) filed this action as the plaintiff in the U.S. District Court for the District of Hawai’i. HDRC, in its representative capacity as a P&A, sought “injunctive and declaratory relief, alleging that DOE's and DHS's policies limiting access to medically prescribed ABA services during the school day violate the Americans with Disabilities Act, Section 504 of the Rehabilitation Act, the Medicaid Act, and the Individuals with Disabilities Education Act (“IDEA”).” Judge Leslie Emi Kobayashi presided.

The plaintiffs filed a motion for a preliminary injunction on November 28, 2018, which was denied on March 8, 2019. The defendants filed a motion for summary judgment on July 29, 2020. On November 30, 2020, the district court allowed HDRC to proceed in its associational standing or representative capacity, but determined HDRC had failed to exhaust IDEA administrative remedies for all of its asserted violations and granted full summary judgment to the state. HDRC appealed to the Ninth Circuit.

The Ninth Circuit, on November 26, 2024, upheld the district court decision on the IDEA claims but reversed the district court on the ADA, Section 504, and Medicaid claims. With respect to the IDEA claims, HDRC asserted it need not exhaust IDEA administrative remedies because of its status as a Protection and Advocacy System. The Ninth Circuit disagreed because although HDRC could proceed on its own behalf “for purposes of associational standing and so are empowered to represent in court the interests of the class of people they were created to protect,” it was still required to exhaust IDEA remedies. The court then proceeded to determine if any exceptions to IDEA exhaustion applied. First, the court summarily concluded there was no futility exception because it thought HDRC or its constituents still had options available to them to obtain relief, some individuals indeed secured relief, and, as such, the IDEA process was not futile.  Second, the court decided HDRC’s challenge did not meet the “general applicability” or system exception because HDRC’s claims were too “limited,” were not “wide-reaching or systemic” enough and challenged only “’one component’ of the special education program, as opposed to asserting that the policies of ‘the entire special education system.’” Last, the court turned away the “inadequacy” exception because of the reasons given for the “general applicability” exception and because the court believed IDEA hearing officers could, under IDEA, give effective relief. Accordingly, HDRC was required to exhaust IDEA claims through the IDEA due process hearing system.

The Ninth Circuit then turned to assessing whether HDRC needed to exhaust IDEA administrative remedies for their ADA, Section 504, and Medicaid claims. The Ninth Circuit examined IDEA and the United States Supreme Court decision in Fry v. Napoleon Community Schools, 580 U.S. 154 (2017) in concluding that HDRC did not have to exhaust those non-IDEA claims. The court agreed with HDRC that its ADA and Section 504 claims did “not concern the provision of educational services."  Last, the Ninth Circuit again agreed with HDRC that it did not need to exhaust its Medicaid claims, reasoning that those claims did “not seek relief from the denial” of a free appropriate public education (FAPE) and that HDRC’s claims challenged the policies of a state agency that had “no obligations under the IDEA.” Further, the court noted that HDRC’s claim involved an alleged denial of “medically necessary” ABA services  during the school day and this too was unrelated to a FAPE claim.

The case was remanded to federal district court for further proceedings.
