This case challenged Hawaii’s Department of Education’s finding that a minor with dyslexia was ineligible for services under the Individuals with Disabilities in Education Act (“IDEA”). 

On March 28, 2008, the guardian of a minor with dyslexia filed this lawsuit in the United States District Court for the District of Hawaii under Chief United States District Judge Helen Gillmore. The guardian sued the Department of Education in the State of Hawaii under the Individuals with Disabilities Education Act, 20 U.S.C. §§ 1400-1487. The complaint alleged that the Department of Education denied the minor free appropriate public education (“FAPE”) and that the minor was eligible for special education and related services under IDEA with the specific learning disability category on account of their dyslexia. Represented by private counsel, the guardian sought (1) declaratory relief stating that the minor is eligible for special education and related services under IDEA and was denied FAPE, (2) reversal of the Officer of Administrative Hearings’ judgment that the minor was not eligible for special education and related services and was not denied FAPE, (3) award of damages for violation of civil rights, and (4) attorneys’ fees and costs incurred.

On November 7, 2008, the guardian filed an amended complaint adding the minor’s mother as a plaintiff in the case, as he was found to not have standing. 

On March 23, 2009, Judge Gillmor affirmed the Administrative Hearings Officer’s Findings of Fact, Conclusions of Law, and Decision and denied the mother’s request for costs and attorneys’ fees. The District Court affirmed the administrative hearing officer’s findings, holding that (1) a state may utilize the severe discrepancy model and (2) the Department of Education did not violate its duty to identify a child with disabilities.

On April 20, 2009, the mother appealed to the United States Court of Appeals for the Ninth Circuit. 

On September 8, 2011, a three-judge Ninth Circuit panel consisting of Judge Betty B. Fletcher, Judge Harry Pregerson, and Judge Richard R. Clifton sitting in Honolulu, Hawaii published their opinion. Judge Pregerson offered the opinion of the panel, in which they opined on three issues. Michael P. v. Dep’t of Educ., 656 F.3d 1057 (9th Cir. 2011).

First, the panel held that the Department of Education’s regulations requiring exclusive reliance on the “severe discrepancy model” violated IDEA. Pursuant to 34 C.F.R. § 300.307(a), states are prohibited from requiring exclusive reliance on the “severe discrepancy model,” a 1.5 standard deviation between one’s actual achievement and their intellectual ability scores, and are required to allow use of the “response to intervention model,” an approach stating that students can learn if effective instruction is provided. The Court of Appeals found Hawaii’s Department of Education procedurally violated IDEA by requiring the use of the “severe discrepancy model” when determining whether a child is eligible for special education under the “specific learning disability” classification.

Second, the panel held that the District Court had the appropriate authority to assess and reach a conclusion regarding the minor’s eligibility for special education. As such, the Ninth Circuit ordered the lower court to determine, by a preponderance of evidence, whether the minor would be eligible.

Third, the panel held that the District Court must also determine whether the minor’s privately procured education, including private school placement, private tutoring, and related services, was appropriate and to award reimbursement accordingly.

Judge Clifton dissented, stating that Hawaii’s Department of Education did not violate IDEA nor was the minor erroneously found ineligible for special education. 

On January 12, 2012, District Court Judge Gillmore remanded the case to the Administrative Hearing Officer, ordering the officer to abide by the Ninth Circuit Court of Appeal’s decision to determine: (1) whether the minor has a “specific learning disability” that entitled them to special education services pursuant to Haw. Code R. § 8-60-41(a)(1)-(2), (2) if the minor was entitled to special education services, whether the minor’s privately procured education, tutoring, and related services were appropriate, and (3) if the minors’ private education was appropriate, the proper amount of reimbursement. 

On March 29, 2012, both the guardian and the Department of Education informed the court they resolved the matters of attorneys’ fees. The request to withdraw the motion for attorneys’ fees was granted. 

On November 6, 2013, Judge Gillmor entered a stipulated judgment in favor of the guardian and against the Department of Education. The judgment awarded the guardian $46,269.48 representing half the cost of the minor’s private program, including educational, tutorial, and related service costs. The judgment was exclusive of attorneys’ fees and costs of litigation.
