The law amended Illinois’ Deceptive Business Practices Act to forbid “unfair methods of competition or unfair or deceptive acts or practices” by limited-service pregnancy centers, and was made effective immediately upon passage. …

This case involves a legal challenge to Illinois Senate Bill 1909 (“SB1909”), a 2023 law intended to prohibit limited services pregnancy centers from employing practices which could be seen as involving deception, mis-representations, or omissions of any material fact. The law amended Illinois’ Deceptive Business Practices Act to forbid “unfair methods of competition or unfair or deceptive acts or practices” by limited-service pregnancy centers, and was made effective immediately upon passage.

On July 27, 2023, the National Institute of Family and Life Advocates, Women’s Help Services, Rockford Family Initiative, Relevant Pregnancy Options Center, and Pro-Life Action League, faith-based organizations in Illinois, sued the Attorney General of the State of Illinois in U.S. District Court in the Northern District of Illinois, Western Division. Plaintiffs assert that, as religious non-profit organizations, they provide resources and counseling to women who are pregnant. As part of their faith-based counseling, they stated that they have the goal of guiding women to choose non-abortion options and to avoid abortifacients or certain contraceptive options. Plaintiffs assert that SB1909 subjects to scrutiny any and every statement or omission made by limited-service pregnancy centers, and was specifically targeted at pro-life organizations like plaintiffs. They argued that SB109 threatens to silence faith-based pro-life messaging by organizations like plaintiffs, and would therefore significantly curtail or entirely diminish plantiffs’ ability to provide services to clients. Plaintiffs alleged: (1) that defendant’s actions violated plaintiffs’ First and Fourteenth Amendment free speech rights under the Free Speech Clause, causing plaintiffs harm by forbidding them from freely publishing or displaying their desired outreach materials without fear of government penalty. (2) Defendant’s actions violated the First and Fourteenth Amendment free exercise of religion rights, under the Free Exercise Clause. (3) Defendant’s actions violated the Equal Protection Clause of the Fourteenth Amendment, by treating parties like plaintiff differently on the basis of their religious beliefs, which is a protected basis from discrimination. (4) Defendants violated procedural due process under the Fourteenth Amendment: Plaintiffs alleged that SB1909 was overly vague, and in failing to provide definitions for “unfair methods of competition” or other practices banned by the law, the law gave defendant unbridled discretion to penalize speech. (5) Defendants violated patients’ right to continue pregnancy under the Fourteenth Amendment, by restricting access to information on certain abortion-related topics. (6) And defendants violated the freedom of expressive association in the First and Fourteenth Amendment, by prohibiting certain organizations from associating with others with similar messages and potentially forcing the inclusion of unwanted messages that would affect plaintiffs’ ability to advocate their viewpoints. Plaintiffs pled for a temporary restraining order and injunction to prevent enforcement of SB1909, and damages.

Simultaneously, plaintiffs also filed a separate emergency motion for a temporary restraining order and preliminary injunction, to enjoin defendant from any enforcement of SB1909.

The matter was assigned to the Honorable Judge Iain D. Johnston and the Honorable Magistrate Judge Lisa A. Jensen.

On August 4, 2023, the court granted the plaintiffs’ motion for preliminary injunction, finding that SB1909 facially violated the First Amendment and violated plaintiffs’ First Amendment rights as applied. The court held that SB19091 constitutes content and viewpoint-based discrimination, targeting speech which emphasizes the negative effects of abortion; the court held that such targeted content-based regulations are presumptively unconstitutional and subject to strict scrutiny. While the court held that the government has a compelling interest in regulating deception in healthcare services, the court ultimately found that SB1909 was not sufficiently narrowly tailored to meet that interest, and therefore would not survive strict scrutiny.

On December 14, 2023, the court issued its agreed permanent injunction order. In that decision, the court ordered that defendant be permanently enjoined from enforcing SB1909, and ordered that the action be dismissed with prejudice, with plaintiffs being allowed leave to file a motion to seek litigation costs.

As plaintiffs prepared to file that motion for costs, the parties entered into settlement discussions to handle the issue of costs. The exact terms of the settlement are not available to the Clearinghouse. On June 27, 2024, the parties submitted a joint motion to extend the deadline by which plaintiffs were required to submit. In that joint motion, the parties reported that they had reached a payment agreement to resolve their dispute regarding plaintiffs’ costs of litigation, but that the payment could be made only after the deadline. The court granted the extension. On July 30, 2024, plaintiffs filed notice with the court that they received payment for their costs of litigation from defendant. No appeal or further development appears to be pending.
