Case Summary

On January 21, 2020, one individual plaintiff and National Defense Committee (“NDC”) filed a suit against the Alabama Secretary of State and the Mobile County Board of Registrars, seeking declaratory and injunctive relief to redress defendants’ alleged violations of the Fourteenth Amendment and the First Amendment due to defendants’ use of ranked choice ballots. This action challenged Alabama’s Instant Runoff Primary Election scheme, or the Ranked Choice Voting scheme (“RCV Scheme”) for voters …

On January 21, 2020, one individual plaintiff and National Defense Committee (“NDC”) filed a suit against the Alabama Secretary of State and the Mobile County Board of Registrars, seeking declaratory and injunctive relief to redress defendants’ alleged violations of the Fourteenth Amendment and the First Amendment due to defendants’ use of ranked choice ballots. This action challenged Alabama’s Instant Runoff Primary Election scheme, or the Ranked Choice Voting scheme (“RCV Scheme”) for voters who voted by absentee ballot pursuant to the Uniformed and Overseas Citizens Absentee Voting Act (“UOCAVA”).  

The RCV Scheme is a ranked choice ballot sent only to UOCAVA voters during primary elections for federal office. In order to cast a ballot in a potential runoff election, UOCAVA voters were asked to rank all candidates in order of preference, after which defendants tabulated the “first-ranked” choices and added those votes to each candidate’s total in the initial primary election tabulations. UOCAVA voters did not receive an additional ballot if a runoff election was necessary. Instead, the defendants tabulated the highest ranked preference for a remaining candidate from the initial primary ballot and distributed those votes during the runoff primary. 

Represented by private attorneys, the plaintiffs sought a declaration that the use of the RCV Scheme was unconstitutional and sought a preliminary injunction directing the Alabama Secretary of State to suspend the implementation of the RCV Scheme. The plaintiffs also requested the court to order the defendants to extend the time between primary and runoff elections by rescheduling the date on which runoff elections were scheduled to take place to allow UOCAVA voters enough time to be sent a separate runoff ballot. In the alternative, plaintiffs requested the court to order the defendants to send UOCAVA voters separate ballots for the runoff election but provide these voters with additional time to transmit their ballots back to the appropriate authorities in Alabama. The case was filed in the United States District Court for the Southern District of Alabama and was assigned to Judge Jeffrey U. Beaverstock. 

On February 19, 2020, the defendants filed a motion to dismiss stating that the plaintiffs lacked standing and that the defendants had sovereign immunity. The defendants also claimed that the plaintiffs’ claim that the defendants’ use of ranked choice ballots violated their First Amendment rights was meritless because any burden was slight and fully justified by the State’s weighty interests. The defendants further claimed that the plaintiffs’ claim that the ranked choice voting schemes risk non-monotonicity was meritless because the plaintiffs failed to challenge the specific system in place in Alabama. 

On March 17, 2020, Alabama Secretary of State arranged for UOCAVA voters to receive traditional (non-ranked) ballots for the 2020 Alabama primary runoff election. Further, on March 18, 2020, the Alabama Governor issued a proclamation postponing the 2020 Alabama primary runoff election date to July 14, 2020. Based on the actions of the Alabama Secretary of State and the Alabama Governor, on March 24, 2020, the District Court ordered the parties to file a joint statement informing the court of their positions on whether these actions render the plaintiff’s motion for preliminary injunction and any other requested relief related to the 2020 Alabama primary runoff election moot. 

Following this, on March 25, 2020, both parties filed a joint stipulation of voluntary dismissal without prejudice, which was endorsed by Judge Jeffrey U. Beaverstock, and the case was dismissed the same day without prejudice.
