Montana law allows for universal mail-in voting in the context of certain local elections. However, the statute makes explicit that this practice does not extend to “regularly scheduled federal, state, or county election[s]”. Ahead of the 2020 election, and amidst the COVID-19 pandemic, Governor Bullock issued a directive allowing counties to expand mail-ballot voting to general elections. 

On September 9, 2020, eligible and registered Montana voters filed a lawsuit in the U.S. District Court for the District of Montana against Stephen Bullock, in his official capacity as Governor of Montana, and Corey Stapleton, in his official capacity as Secretary of State of Montana. Represented by private counsel, the plaintiffs sought injunctive and declaratory relief under 42 U.S.C. § 1983. The plaintiffs claimed that Governor Bullock’s directive violated their First and Fourteenth Amendment right to vote by creating risk of election fraud and voter disenfranchisement. They argued that the directive violated the Equal Protection Clause of the Fourteenth Amendment by advantaging voters in certain areas (i.e., those counties electing to utilize mail ballot procedures for the November 2023 election) while disadvantaging others (i.e., voters in counties that elect not to use mail ballot procedures for the November 2023 election). Plaintiffs also claimed that the directive ran afoul to Article I, Section IV, clause 1 (the “Elections and Electors Clauses”) of the Constitution of the United States because it changed the time, place and manner of a Montana’s federal election without legislative involvement. On September 9, plaintiffs also moved for a preliminary injunction of the directive.

Another case, Donald Trump for President, Inc., et al. v. Stephen Bullock, et al., raised the same constitutional challenges as to the same directive from Governor Bullock. Accordingly, on September 9, 2020, Judge Dana L. Christensen ordered that the two cases be consolidated. A consolidated injunctive and merits hearing was held for both cases on September 22, 2022.

On September 30, 2020, the court rejected plaintiffs’ requests for injunctive and declaratory relief, ruling in favor of defendants in both Lamm, et al. v. Bullock, et al. and Donald Trump for President, Inc., et al. v. Stephen Bullock, et al., Judge Dana Christensen first held that Governor Bullock acted with authority, granted by Montana statute, to “suspend the provisions of any regulatory statute prescribing the procedures for conduct of state business or orders or rules of any state agency if the strict compliance with the provisions of any statute, order, or rule would in any way prevent, hinder, or delay necessary action in coping with the emergency or disaster”; in so acting, Governor Bullock did not violate the Elections and Electors Clauses of the United States Constitution. Second, the court found plaintiffs’ claims that the directive would violate the constitutional right to vote to be without merit. While plaintiffs argued that the mail ballot system would lead to widespread voting fraud and voter disenfranchisement, the court noted the lack of supporting evidence, calling the claim a “fiction.” Indeed, the court emphasized that “electoral safeguards designed to protect the integrity of Montana’s elections” remained in place, untouched by Governor Bullock’s directive. Third, the Equal Protection claim was struck down, as there was no evidence of disparate treatment of Montana voters. Lastly, the court found that granting plaintiffs’ request for injunctive relief would not serve the public interest. In addition to the threat of the ongoing COVID-19 pandemic in an in-person voting context, changing election procedures shortly before an election “would likely bring about significant disenfranchisement.” 491 F. Supp. 3d 814.

On September 30, 2020, Lamm plaintiffs appealed and moved for a stay of the order pending appeal. The District Court denied the motion the same day. On October 6, 2020, the Ninth Circuit denied appellants’ motion for injunctive relief pending appeal. 

On October 6, 2020, plaintiffs sought an emergency writ of injunction from the Supreme Court. Justice Kagan denied the application on October 8, 2020.

On February 1, 2021, plaintiffs, as appellants, moved for an extension of time to file its opening brief. On March 8, 2021, appellants filed a motion with the Ninth Circuit to voluntarily dismiss the case. The Ninth Circuit granted this motion on March 9.
