This case involved allegations that failures of Florida’s online voter registration system on the afternoon of the registration deadline, and failures of the Florida Secretary of State to adequately publicize extension of the registration deadline as a remedy, deprived aspirational voters of their fundamental rights to vote. Although critical of the state, the court ultimately found the failures not to rise to the level of constitutional violation and denied a request for preliminary injunction.

Four Florida nonprofit corporations and membership organizations, including Dream Defenders, New Florida Majority, Inc., Organize Florida, and Florida Immigrant Coalition (collective “Organizational Plaintiffs”), along with an Individual Plaintiff who attempted but failed to register using Florida’s online voter registration system filed suit the U.S. District Court for the Norther District of Florida (Tallahassee Division) on October 6, 2020. Defendants included the Governor of Florida and Florida Secretary of State. Plaintiffs were represented by private counsel, LatinoJustice PRLDEF, and Advancement Project. Plaintiffs cited 42 U.S.C. §§ 1983 and 1988 and sought to redress the deprivation of rights secured by the United States Constitution. The case was assigned to Chief Judge Mark Walker.

Plaintiffs stated that they experienced sustained problems using Florida’s online voter registration system beginning around 2:00 pm and continuing until at least 11:30 pm on October 5, 2020, which was the deadline for 2020 general election registration. As a result, the Organizational Plaintiffs were not able to assist thousands of aspirational voters with their voter registrations and the Individual Plaintiff was not able to register to vote before the deadline. Plaintiffs sought injunctive and declaratory relief. They sought injunctive relief to enjoin Defendants from enforcing the October 5, 2020 voter registration deadline and to order Defendants to extend the deadline to midnight on the second day after the date of any order of the court. Plaintiffs also filed an emergency motion for a temporary restraining order and preliminary injunction along with the Complaint.

Defendants filed their opposition to Plaintiff’s motion on October 6, 2020. In the meantime, one of the Defendants (Florida Secretary of State) issued a press release around 12:20 pm on October 6, 2020, stating that she had issued a directive extending the voter registration deadline earlier in the day, and that this directive would permit potential voter registrants to submit online applications until 6:59 pm on October 6, 2020. Defendants argued that this extension allowed the individuals referenced in this litigation to register, that this extension alleviated the purported burden on anyone’s right to vote, and that granting another extension would cause voter confusion and mistrust, lead to additional tasks that would overwhelm the election administration, and harm the public interest. Defendants also presented other arguments, including that (1) Plaintiffs had no standing, (2) the Supreme Court’s Purcell Doctrine barred relief as judicially created voter confusion when regulations are challenged close to an election, and (3) the Governor was not a proper party and thus the action against the Governor should be dismissed.  

The court responded to each of Defendants’ arguments. As threshold matters, the court found that each Plaintiff had standing. Of note, it found that the Organizational Plaintiffs adequately alleged injury to their efforts by the complained failure.  The Court acknowledged a trend on specific facts, to “leave elections to States” following Purcell, but concluded that neither Purcell nor this trend “create[ed] a per se rule prohibiting against enjoining unconstitutional voting laws or procedures on the eve of the election,” and thus would analyze the particular facts of this case in light of Purcell. The court agreed with Defendants that the Governor was not a proper party because the Governor lacked the authority to extend the deadline. The court found the Secretary of State to be a proper party.

The court considered the merits of this case to be “an incredibly close call,” but denied Plaintiff’s motion for preliminary injunction. The court applied the Anderson-Burdick framework, under which a court considering a challenge to a state election law “must weigh ‘the character and magnitude of the asserted injury to the rights protected by the First and Fourteenth Amendments that the plaintiff seeks to vindicate’ against ‘the precise interests put forward by the State as justifications for the burden imposed by its rule,’ taking into consideration ‘the extent to which those interests make it necessary to burden the plaintiff’s rights.’” The court took into account the fact that the Secretary of State extended the deadline by several hours and directed Florida’s supervisors of elections to accept paper applications postmarked by October 6, 2020, as well as in person applications completed before 7:00 pm of the same day. The court noted that these directives “unquestionably mitigated” the burden on the right to vote. The court also noted that the consequences of extending the deadline again would force election officials to “divert resources to answering calls and processing new registrations—thereby hampering other important tasks, such as processing vote-by-mail requests and ballots, and administering early voting.” The court expressly noted the already precarious and confusing conditions given the Covid pandemic.  The court concluded that, based on the record, “protecting the integrity of Florida’s elections outweigh[ed] the burden placed on the voting rights of Floridians,” and denied Plaintiff’s motion for preliminary injunction.  

Plaintiffs filed a motion for voluntary dismissal on October 13, 2020.
