This case stems from COVID-related accommodations made by Allegheny County, Pennsylvania during the 2020 election. On September 17, 2020, in response to concerns related to the pandemic and in an effort to ensure that voters had safe, acceptable options to vote in person or return their ballots, the Allegheny County Board of Elections unanimously to open additional, satellite offices at which to administer the election.

After the election began, on October 16, 2020, Republican candidates for Pennsylvania’s 17th and 18th  Congressional Districts (the “Plaintiffs”) brought suit in the U.S. District Court for the Western District of Pennsylvania, claiming that Allegheny County was administering the election contrary to the mandates set forth in the Constitution and under Pennsylvania law. First, the Plaintiffs argued that Constitution’s elections clause prohibited the Allegheny County Board of Elections from unilaterally creating new election regulations (as was alleged to be the case in the creation of satellite offices). Second, the Plaintiffs claimed that a mishandling of roughly 29,000 ballots – including mailing ballots to the wrong recipients and subsequently reissuing revised ballots – justified review of the legitimacy of the voting processes in Allegheny County. Finally, the Plaintiffs argued that the Allegheny County Board of Elections’ alleged refusal to allow poll watchers at the satellite offices was a violation of Pennsylvania law and the equal protection clause of the 14th Amendment. In connection with their suit, the Plaintiffs sought judicial review in the form of a declaration regarding the legitimacy of the ballots cast at satellite offices and an injunction prohibiting the Board of Elections from refusing poll watchers at satellite offices. Plaintiffs later amended the complaint to add two poll watchers as additional plaintiffs.

On October 20, 2020, the court entered a scheduling order, which, in relevant part, required the parties to meet and confer to discuss (1) a “standstill” on the treatment of the ballots received by Allegheny County from voters that had received incorrect absentee and mail-in ballots; (2) whether the defendants – the Allegheny County Board of Elections and its Members (together, the “Defendants”) – would allow the Plaintiffs to inspect the facility where the ballots were being stored; and (3) whether the Defendants would consent to allowing poll watchers at satellite offices under specified conditions.  In the interim, the court held a hearing on plaintiff’s motion for a temporary restraining order in connection with the procedures that Allegheny County had been using.  Following the hearing, the court – via text order – denied the motion for temporary restraining order on the basis that the Plaintiffs were unable to show that they were likely to prevail on the merits or that they were likely to suffer irreparable injury without relief.

After multiple conferrals, status conferences, and status reports, the parties advised the court on October 25, 2020 that they had reached an amicable resolution and filed a corresponding consent order.  Per the order, the parties agreed, in relevant part, that:

  • The Board of Elections would maintain its practice of sorting, segregating, and preserving initial and corrected ballots of affected voters;
  • The Board of Elections would not pre-canvass any of the foregoing ballots until after the ballot acceptance deadline to ensure that only one ballot was counted per voter;
  • The Board of Elections would follow specified sorting and counting procedures in connection with ballots returned by affected voters; and
  • Plaintiffs would voluntarily dismiss the case.

On October 26, 2020, the court signed the consent order, and the case was closed.
