Case Summary

This is a voting rights case brought by a prisoner Wende Correctional Facility in Alden, New York against New York State.  On December 8, 2020, the prisoner mailed a standard form complaint to the Western District of New York, alleging that he had been deprived of the right to vote in violation of the U.S. Constitution and 42 U.S.C. § 1983.  The Western District of New York received the mailed filing on December 10, 2020 and opened a case on the same day.

Days later, on December 18, 2020, the court dismissed order the clerk to administratively close the case for the plaintiff's failure to pay the necessary filing fees or, alternatively, submit a proper motion to proceed in forma pauperis (i.e., without needing to pay court fees).
