This case is about keeping voting locations in LA County open longer than the local county election code allows.
Specifically, on March 3, 2020, Bernie 2020, a nationwide political committee operating on behalf of then-Candidate Sanders, filed a complaint and demand for an emergency temporary restraining order (TRO), under 42 U.S.C. Sec. 1983, against the Los Angeles County Registrar Recorder/County Clerk in the U.S. District Court for the Central District of California. Plaintiffs sought to prevent polling locations in Los Angeles County from closing at 8 pm on March 3, 2020 because of extreme wait times and to ensure LA County voters were able to exercise their right to vote. The complaint cited various examples of extreme wait times ranging from one hour to four hours. The complaint claimed these extreme wait times violated the First and Fourteenth Amendments. The case was assigned to district court judge Consuelo B. Marshall on March 5, 2020.
On March 5, 2020, the Court dismissed the Complaint as moot and summarily denied the TRO request because the case was not assigned to the Court until March 5, 2020, two days after the election, thus making the claim for relief moot.
