This is a case about a private citizen who alleged that his name was improperly excluded from the ballot for President.
On November 10, 2020, a private citizen of Alabama filed this lawsuit in the United States District Court for the Middle District of Alabama, however, the case was transferred to the United States District Court for the District of Nevada pursuant to 28 U.S.C. 1404(a) (to which there were no objections). The plaintiff sued Donald Trump as the President of the United States, Mike Pence as the Vice President of the United States, Barbara Cegavske as the Nevada Secretary of State, and the Clarke County Registrar of Voters, Joseph P. Gloria, alleging violations of his Fourteenth Amendment Rights. Represented by himself, the plaintiff sought monetary damages for alleged emotional distress and a Court Order for 900 trillion dollars. He claimed that his emotional distress is valued at 900 trillion dollars, because he claims that his platform promised 1 million dollars in economic stimulus checks for each American citizen.
On November 10, 2020, Plaintiff filed a complaint alleging as follows: "The Secretary of State of the State of Nevada use [sic] software that excluded my name from being placed on the ballot in every country of the State of Nevada and Donald Trump in his official capacity as U.S. President encourage and support these acts." He further alleged that his primary injury is emotional distress, which he valued at 900 trillion dollars, as he claimed that the injury hurt the American people when they were disallowed to vote for a candidate who promised one million dollars in economic stimulus checks for each American citizen.
On December 18, 2020, the case was transferred from the Middle District of Alabama to the District of Nevada, without objections.
On April 7. 2021, the United States Magistrate Judge, Daniel J. Albregts, issued a Report and Recommendation that the case be dismissed without leave to amend. The Magistrate Judge reasoned that the claims were clearly baseless because the plaintiff failed to state any sort of cognizable claim, or any claim at all. He does not address how he could run for office in Nevada when he is an Alabama resident or any logical set of facts or rights that may have been violated. On May 4, 2021, the Magistrate Judge's Report and Recommendation was adopted by the District of Nevada and the action was dismissed as frivolous.
