This is a case about 2020 Biden/Harris voters who alleged that Donald Trump and other officials, along with Fox News Channel, committed several violations of constitutional rights and conspired to violate such rights.
On December 31, 2020, three private plaintiffs who voted for Biden/Harris in 2020 filed this lawsuit in the United States District Court for the District of Columbia. The plaintiffs sued Donald Trump, Mitch McConnell (the Majority Leader of the U.S. Senate), and the Fox Corporation. Represented by themselves, the plaintiffs sought declaratory judgment finding the defendants to have violated Constitutional rights. They claimed that the defendants committed crimes, which were not investigated or prosecuted, and held those with political power to be above the law. The plaintiffs asked 23 "Constitutional questions" whereby they asked the Court to determine if different actions by the defendants violate any provision of the Constitution. The questions asked about ignoring crimes and pardoning crimes, undermining separation of powers with Supreme Court justices that the plaintiffs allege are politicized and result in unfair discriminatory decisions, political gerrymandering resulting in more direct voter suppression, the war of Russia against the U.S. aided and abetted by the defendants, and the politicization of COVID-19. The complaint details allegations of abuse of power to subvert the First Amendment by Fox and Trump, the politicization and weaponizing of COVID-19 causing unnecessary deaths, and the defendants acting against the Republic and inciting violence, and voter suppression through politicization of vote by mail.
On April 6, 2021, the Court entered a Minute Order directing the plaintiffs to file proof of service or a status report updating the Court of the status of service by no later than April 26, 2021.
On May 21, 2021, the Court entered another Minute Order that in light of the plaintiffs' failure to comply with the prior Minute Order regarding service, or otherwise prosecute the action, the Court dismissed the case without prejudice. This case appears closed.
