Prior to this case, the plaintiff, along with two other men, were charged with 21 U.S.C. 841(a)(1) and 853 conspiracy to possess with intent to distribute crack cocaine. Neither charge came with a threshold amount of substance. The plaintiff alleged that he and his co-conspirators were charged with the "maximum penalty," even though the indictment never stated a specific quantity of cocaine.
On March 12, 2020, one individual plaintiff filed a pro se lawsuit against the defendant, the sentencing judge in his drug case. The plaintiff alleged that the judge abused his discretion and engaged in "unprofessional conduct" by directed the jury to consider the amount of cocaine at the time of sentencing. The plaintiff sought 10 million dollars in compensation for his "unlawful detention." The case was filed in the United States District Court for the Southern District of Florida and assigned to Judge Beth Bloom.
On March 12, 2020, the District Court dismissed the lawsuit without prejudice because the complaint failed to state a claim.
