Nonprofits filed suit against the Baltimore County Council’s plan to redistrict as a violation of Section 2 of the Voting Rights Act, 52 U.S.C. § 10301. The Council proposed a plan that would concentrate Black voters in one district where they would make up more than 50 percent of the voting population out of seven total districts, even though the Black population had increased countywide from about 20 to 30 percent since the early 2000s. The plan also meant that only one district would have more than 30 percent of Black voters of voting age. The nonprofits sought an injunction preventing the plan from taking effect and a declaratory judgment that the plan violated the Voting Rights Act.

After public backlash, the Baltimore County Council moved forward with enacting its redistricting plan, asserting this would ensure that Black voters’ voices were heard in one district, while public outcry maintained that it violated the Voting Rights Act given the growth in the Black population. The plan was enacted on December 20, 2021, and the plaintiffs filed suit the next day. The plaintiffs then filed a motion for a preliminary injunction, asserting that the plan enacted under Bill 103-21 should be struck for violating the Voting Rights Act and that a lawful plan should ensure two majority Black districts supported by population growth and a third influence district for BIPOC voters.

The plaintiffs focused on the Gingles prerequisites and additional Senate factors to determine whether the Voting Rights Act had been violated. They argued that 1) another compact minority district could be drawn, 2) the relevant communities would be cohesive, and 3) white voters vote as a bloc to defeat Black voters. The most important Senate factors in this case, according to the plaintiffs, were that voting is highly racially polarized and that Black candidates consistently lose in white districts. The plaintiffs further argued that it would cause irreparable harm for an election to take place under the Council’s map and that balancing the equities favored a preliminary injunction.

The defendants responded that the plaintiffs failed to 1) show that another compact minority district could be drawn, 2) demonstrate that Black voters in Districts 1 and 2 are politically cohesive, and 3) establish racially polarized voting in the county, asserting that there were no preferred Black candidates and that preferred Black candidates have had success. The defendants argued that the totality of the circumstances does not show voter dilution and that a preliminary injunction is not justified.

The plaintiffs replied that the defendants’ brief demonstrates a violation of the Voting Rights Act. A compact additional district could be created, the relevant communities are cohesive, and white voters do vote as a bloc to block Black voters’ choices. The plaintiffs focused on the example of the election of Cheryl Pasteur that the defendants raised and argued that the defendants failed to conduct a statistical analysis of electoral performance and failed to rebut the plaintiffs’ Senate factor evidence. The plaintiffs further argued that the defendants failed to present evidence that a preliminary injunction would be inequitable.

On February 22, 2022, the court granted the plaintiffs’ motion for a preliminary injunction. The court found that the plaintiffs had shown likely success on the merits. The plaintiffs presented sufficient evidence that a second majority Black district could be created, that the district would be politically cohesive, and that a white voting bloc usually defeats Black preferred candidates. The court concluded that the totality of the circumstances does not support the defendants’ position that Black voters would have equal access to elect their candidates of choice. The court ordered the defendants to submit a new redistricting map that created a second district in which Black voters could effectively elect their preferred candidate.

On March 8, 2022, the defendants submitted a new redistricting map and asked the court to modify the preliminary injunction. The new map maintained the first majority Black district and added a crossover district. On March 17, the defendants submitted a brief in support of their new map and argued that the plaintiffs’ alternative map should not be accepted. On March 17, 2022, the plaintiffs submitted a brief contending that the defendants’ additional crossover district did not adequately address the court’s order on the preliminary injunction.

On March 25, 2022, the court approved the county’s new redistricting map, finding that the new district increases the power of Black voters in a second district. The court asserted that the defendants presented evidence of sufficient white crossover voting to permit Black voters to elect their candidate of choice.
