The plaintiffs sued election officials in Benton, Yakima, and Chelan counties, arguing that the counties’ mail-ballot signature-verification systems were rejecting Latino voters’ ballots at disproportionately high rates. Washington conducts most elections by mail, and every ballot envelope must be signed; county staff compare that signature to the one on file, and if they decide it “doesn’t match,” the ballot is rejected unless the voter completes a cure process.

The plaintiffs alleged that this process was being carried out inconsistently and discriminatorily, resulting in Latino voters being several times more likely than non-Latino voters to have their ballots thrown out for supposed signature mismatches. They argued that the verification standards were vague, training for staff is inadequate, and cure procedures are not equally accessible. Based on those allegations, the suit asserted violations of the U.S. Constitution (specifically the First, Fourteenth, and Fifteenth Amendments) as well as Section 2 of the Voting Rights Act, which prohibits election practices that deny minority voters an equal opportunity to participate in the political process.

Over the course of the litigation, all three counties moved toward resolution. Chelan and Benton Counties reached settlements in October 2023, agreeing to reforms such as standardized signature-verification training and improved voter-notification and cure procedures. Yakima County reached a similar settlement in December 2023, shortly before trial was set to begin. These agreements generally require clearer guidelines for staff, periodic training (including cultural-competency training), and better public information about how signatures are evaluated and how voters can remedy a challenged ballot.

As of now, the case is effectively resolved through these county-by-county settlements, with the plaintiffs treating the reforms as a meaningful step toward more consistent and equitable ballot-processing practices.
