This is a case brought by the Libertarian Party of Illinois arguing that the Libertarian Party should be considered an “established political party” under the Illinois Election Code and is thus entitled to the rights and privileges of major political parties. 

On February 1, 2022, the Libertarian Party of Illinois, a political party, and a number of registered voters, holding membership and various leadership roles within the party, filed suit in the Northern District of Illinois against Defendants, including the Cook County Clerk and other individuals in their official capacities as Commissioners of the Chicago Board of Election Commissioners. Later in the case, Plaintiffs and several Defendants filed a stipulation dismissing Chicago Board of Election Commissioners and Marisel A. Hernandez, William J. Kresse and June A, Brown, each in his or her capacity as Commissioner of the Chicago Board of Election Commissioners, as Defendants from the case. This left the Cook County Clerk as the sole Defendant.

Plaintiffs first pointed to the Illinois Election Code, which states that a political party is an “established political party” if “…at the last election in any congressional district, legislative district, county, township, municipality or other political subdivision or district in the State, polled more than 5% of the entire vote cast within such territorial area or political subdivision, as the case may be, has voted as a unit for the election of officers to serve the respective territorial area of such district or political subdivision…within the meaning of this Article as to such district or political subdivision…” (Dkt. 1, p. 7). According to Plaintiffs, the Libertarian Party’s candidate had 6.71% of the vote for the office of Cook County’s State Attorney in the 2020 election and, as such, should be treated as an “established political party” as to “all elections held within the geographic boundaries of Cook County, IL” (Dkt. 1, p. 10, emphasis added).

As an established political party, the Plaintiffs argued that the procedures and requirements as to Libertarian Party candidates for county offices and the election of township committeepersons are governed by Article 7 of the Election Code, as opposed to Article 10, which applies to “minor political parties” (See Dkt. 25, p. 2). Plaintiffs argued that the Libertarian Party is entitled to the rights and benefits under Article 7 of the Election Code, including but not limited to “a lower signature requirement than new political party candidates, nomination of candidates at a primary election, the ability to elect party officers including township committeepersons at a primary election, the ability to nominate candidates for the general election ballot where there are vacancies in nomination at a primary election…” (Dkt. 1, p. 16).

Plaintiffs conceded that the Defendant did recognize the Libertarian Party’s established status as to the election of countywide offices including Cook County Board President, Clerk, Assessor, Sheriff, Treasurer. However, Plaintiffs argued that the Defendant’s violated the Election Code by “den[ying] established political party recognition to the Libertarian Party for purposes of nominating its candidates for Cook County Commissioners, for election of Libertarian Party township committeepersons … and the corresponding application of Article 7 of the Election Code for purposes of allowing the Libertarian Party to nominate its candidates for Cook County Commissioners at the June 28, 2022 primary election, and elect its Cook County township committeepersons at the June 28, 2022 primary election.” (Dkt. 1, p. 14)

Plaintiffs also claimed that Defendant “willfully and intentionally den[ied] to Plaintiffs their First Amendment rights of association and of ballot access, and their Fourteenth Amendment right to equal protection under the law” (Dkt. 1, p. 2).

As such, the Plaintiffs asked the Court to issue a declaratory judgment that the Libertarian Party was an “established political party” within Cook County, IL, and is accordingly entitled to the rights and privileges provided by the statute. Plaintiffs also moved for preliminary injunction, to essentially enjoin Defendant from any actions that fail to treat the Libertarian Party as an “established political party” under the letter of the law. Specifically, Plaintiffs asked the Court to, among other things, (i) direct Defendant, as Clerk, to amend her “General Information” public disclosure to identify the Libertarian Party as an “established political party” for all offices, and to accordingly include signature requirements for the nomination of Libertarian Party candidates; (ii) notify the public of the foregoing amendment to the “General Information” public disclosure; and (iii) direct Defendant to accept Libertarian Party’s nomination papers for the June 28, 2022 primary local election and prepare for such election to include such candidates.

In response to the Complaint, and in opposition to the Plaintiffs’ motion for injunctive relief, Defendant argued that Plaintiffs are not “established political party” with respect to every election “within the territorial boundaries of Cook County” (Dkt. 25, p. 1).  Defendant interpreted the statute to mean that the Libertarian Party can be deemed “established” as to County Board Commissioners and Township officers only if the party polled at least 5% in the last election where such officers were elected.

Defendant also argued that Plaintiffs failed to show a constitutional violation warranting injunctive relief.

The case was assigned to Robert W. Gettleman as Magistrate Judge and Jeffrey Cole.  

On March 4, 2022, the Court granted Plaintiffs’ motion for injunctive relief.

On May 19, 2022, after oral arguments and deliberations, the Court entered a consent judgment order pursuant to which declaratory relief was granted; the Libertarian Party of IL was deemed a “duly established political party within Cook County, IL for all ‘county offices’ including nomination of Cook County Board commissioners and Cook County Board of Review commissioners, and for purposes of electing its committeepersons for the 2022 election cycle…” (Dkt. 46, p. 2).

The case is now closed.

Gettleman: Having considered the plaintiffs' petition for fees and costs 53, the joint LR 54.3 statement, along with the parties' briefs and exhibits, the court awards plaintiffs the sum of $31,780 in attorneys' fees, along with $869.05 in costs. In reaching this conclusion, the court finds, based on its experience in civil rights and comparable cases, that an hourly rate of $350 is reasonable and frequently awarded in this district to prevailing parties. The court agrees with defendant that the time spent preparing the fee petition is excessive, and reduces those hours by 50% (to 6.4 hours). The court declines to award plaintiffs any fees incurred since July 6, 2022. Consequently, the court finds that plaintiffs are entitled to be compensated for 90.8 hours of their attorney's time (deducting the 3.7 hours plaintiffs have agreed to withdraw) at the rate of $350 per hour, or $31,780. The parties agree that the number of hours incurred by plaintiffs' attorney is 78, rather than the 90.8 hours found by the court in its October 5, 2022, Order (Doc. 59 ). Having again reviewed the submissions by both parties, the court reaffirms the hourly rate of $350 as consistent with similar awards of attorney's fees in civil rights cases in this district, and is approximately a mid-way point between the hourly rate advocated by defendant and the rate sought by plaintiffs.
