This is a case about challenging the constitutionality of enforcing a congressional election based on a map or plan different from the map currently enacted by the State Legislature.

On October 31, 2019, the plaintiffs, individual voters and a candidate, filed this lawsuit in the United States District Court for the Eastern District of North Carolina. The plaintiffs sued the North Carolina House of Representatives, the North Carolina Senate, and the State Board of Elections under 28 U.S.C. §§ 2201 and 2202. Represented by private counsels, Higgins Benjamin, PLLC and Davis, Sturges & Tomlinson, PLLC, the plaintiffs sought temporary and permanent injunctive relief enjoining the legislative defendants from enforcing a congressional election based on a map or plan different from that currently enacted by the State Legislature, namely, the 2016 North Carolina Congressional Plan; award Plaintiffs their costs, disbursement and reasonable attorneys’ fees incurred in bringing this action pursuant to 42 U.S.C.  Section 1988; tax the costs of this action against Defendants; and grant such other relief as this court seems just and proper. They claimed that, should changes be made by the state legislature or state board of elections in the congressional districts, the costs of campaigning will rise and the candidates will need to employ expensive advertising to reach voters in areas which are not currently contained in their districts. To support their assertion, the plaintiff individual voters and the candidate alleged that the United States Supreme Court has recognized in Purcell vs. Gonzales, 549 U.S. 1 (2006), the principle that late changes to the election process will, at a certain point, rise to a level that the confusion engendered will violate the voters and candidates’ rights assured under the due process and equal protection clauses as well as the First Amendment of the United States Constitution.  The individual voters and the candidate alleged that in North Carolina this point had already been passed. The case was assigned to the United States District Judge Louise W. Flanagan.

On November 1, 2019, the intervenor individual voters filed the Motion to Intervene as Defendants along with the Memorandum of Law in Support of Motion to Intervene as Defendants. The intervenor individual voters were the plaintiffs in the state court lawsuit challenging North Carolina’s 2016 congressional districting plan. Harper v. Lewis, Case No. 19CVS12667. On October 28, 2019, the state court granted the intervenor individual voters’ motion for preliminary injunction, finding that the 2016 plan violated rights protected under the state constitution, and enjoining use of the plan in the 2020 primary and general elections. The intervenor individual voters alleged that, three days later, on October 31, 2019, the plaintiff individual voters and the candidate filed this lawsuit, listing the same defendants named in the state court action, and sought to enjoin the state court action, to undo the preliminary injunction that the intervenor individual voters have already obtained in Harper v. Lewis, and to deny the them a remedy for the violation of their state constitutional rights as found by the state court.

On November 8, 2019, the plaintiff individual voters and the candidate filed the Plaintiffs’ Motion for Preliminary Injunction along with the Plaintiffs' Memorandum in Support of Their Motion for Preliminary Injunction. In the Motion, the plaintiff individual voters and the candidate claimed that should declare the rights of the parties, grant the Plaintiffs’ Motion for Preliminary Injunction and direct the legislative defendants to suspend implementation of any revisions to North Carolina’s current congressional election districts as enacted by the General Assembly in Session Law 2016-1.

On November 12, 2019, the plaintiff individual voters and the candidate filed the Amended Complaint for Declaratory Relief, Injunction, and for Attorney Fees for Violation of Civil Rights under Section 1983.

On November 18, 2019, the court issued the Order granting the individual defendant voters’ Motion to Intervene as Defendants.

On November 22, 2019, the legislative defendants filed the Response to Plaintiffs’ Motion for Preliminary Injunction. In the Motion, the legislative defendants alleged that this case was moot because the General Assembly had fully replaced the 2016 North Carolina Congressional Plan challenged by the plaintiffs, the intervenor individual voters in this case, in the state court case of Harper v. Lewis. On the other hand, the legislative defendants stated that, if the state court in Harper v. Lewis concludes that the matters alleged by the Harper v. Lewis plaintiffs were not moot, and either changes the 2019 Congressional Plan or allowed a challenge to that plan to proceed, then the issues raised by the Brewster plaintiffs in the instant case were not moot.

On November 22, 2019, the intervenor individual voters filed the Intervenors’ Brief in Support of Their Motion to Dismiss and Opposition to Plaintiffs’ Motion for Preliminary Injunction. In the Motion, the intervenor individual voters argued that: (i) the court need not consider the plaintiff individual voters and the candidate’s Motion for Preliminary Injunction because thy failed to establish Article III standing; (ii) this court should adhere to the Supreme Court’s instruction and defer to ongoing state redistricting proceedings; (iii) the plaintiff individual voters and the candidate’s lawsuit was wholly insubstantial and should be dismissed, or, in the alternative, their Motion for Preliminary Injunction should be denied.

On November 22, 2019, the intervenor individual voters filed the Intervenors’ Motion To Dismiss Amended Complaint Under FED. R. CIV. P. 12(B)(1).

On December 2, 2019, the court issued the Order denying the Motion for Preliminary Injunction. In the Order, the court stated that the relief sought in the instant motion (“to suspend implementation of any revisions to North Carolina’s current 2 congressional election districts as enacted by the General Assembly in Session Law 2016-1,”) was moot because the congressional districts enacted in Session Law 2016-1 were not the current congressional election districts. Furthermore, the court stated that the plaintiff individual voters failed to demonstrate a likelihood of success on the merits, where state court proceedings addressing recently-enacted congressional districts were ongoing on an expedited basis, and where, in such circumstances, “a federal court must neither affirmatively obstruct state reapportionment nor permit federal litigation to be used to impede it.” Growe v. Emison, 507 U.S. 25, 34 (1993).  

On December 5, 2019, the plaintiff individual voters and the candidate filed the Notice of Voluntary Dismissal Pursuant to F.R.C.P. 41(a)(1)(A)(i).
