This is a case challenging Indiana State officials’ approval and use of direct recording electronic voting machines (DREs) to record and tabulate votes in the majority of Indiana counties.  

On October 17, 2019, a non-profit organization and five registered voters filed this lawsuit in the U.S. District Court for the Southern District of Indiana.  Plaintiffs sued the Indiana Election Committee, as well as members of the Indiana Election Committee and the Indiana Secretary of State (in their official capacities) under the Fourteenth Amendment (Equal Protection) and an unspecified provision or amendment (for the right to vote) of the U.S. Constitution and various provisions of the Indiana Constitution.  Plaintiffs invoked jurisdiction under 28 U.S.C. § 1331 (federal question), 28 U.S.C. § 1343 (civil rights cases), 28 U.S.C. § 1367 (supplemental jurisdiction), and 28 U.S.C. §§ 2201 and 2202 (declaratory judgment).  Represented by private counsel, plaintiffs sought an order (a) declaring that two Indiana statutes were unconstitutional to the extent they permited use of machines without a voter-verified paper audit trail (VVPAT) through 2030 and failure of Defendants to decertify DRE machines without VVPAT was unconstitutional; (b) enjoining the renewal of certification for any DRE machine without VVPAT (and requiring decertification of such machines); (c) requiring all counties to conduct risk-limiting audits with the VVPAT from voting machines; and (d) payment of attorneys’ fees and costs.  

Plaintiffs claimed that the DRE machines used touch-screens that did not provide voters with a voter-verified paper trail that allowed them to confirm their ballots are counted as cast.  Plaintiffs alleged these machines were susceptible to hacking, may have had undetected bugs, and prevented the conduct of accurate and complete post-election audits or recounts.  Although state legislation passed requiring counties to stop using electronic voting systems without a VVPAT, the law was not effective until 2030.  Plaintiffs alleged voters in counties using DRE machines suffered violations of their right to vote, equal protection, and state constitutional rights to equal privileges and “free and equal” elections.  The case was assigned to District Judge Sarah Evans Barker and Magistrate Judge Mark J. Dinsmore.   

On January 16, 2020, Plaintiffs filed an Amended Complaint for Declaratory and Injunctive Relief that dropped the Indiana Election Committee as a defendant.

On July 2, 2020, the parties filed a Stipulation of Dismissal Without Prejudice without specifying whether the parties had reached a separate resolution.  On July 8, 2020, the District Court “acknowledged” the stipulation and dismissed the case without prejudice.
