On August 9, 2019, Plaintiff, a private citizen, filed this complaint pro se in the Western District of Missouri. In the complaint, Plaintiff accused Ben Carson in his capacity as Secretary of Housing and Urban Development of (1) breaching a duty to provide Plaintiff housing and (2) murdering Plaintiff's nephew in an attempt to prevent Plaintiff from obtaining the same. Plaintiff sought "specific performance" compelling Ben Carsen to provide Plaintiff housing. Judge Phillips dismissed the case on August 12, 2019, noting that the court may dismiss a claim as factually frivolous where the facts alleged "are clearly baseless, a category encompassing allegations that are fanciful, fantastic, and delusional," which the court found to be true in this case.
