This is a case about alleged voter dilution of Black voters in the City of Pleasant Grove, Alabama. 

On December 13, 2018, the Alabama NAACP along with two registered voters (collectively, the "Plaintiffs") filed a complaint against the City of Pleasant Grove, the members of City council, and the mayor of the City.  The complaint alleged that the Defendants' use of an at-large, numbered-place method of electing the members of City council violated (a) Section 2 of the Voting Rights Act ("VRA"), and (b) the Fourteenth and Fifteenth Amendments to the U.S. Constitution.  The Plaintiffs requested that the City be enjoined from using the At-Large Voting Method, and also requested that the Defendants pay Plaintiffs' attorneys' fees. The case was assigned to Judge L. Scott Coogler. 

The Plaintiffs alleged that the use of the At-Large Voting Method diluted the power of Black voters.  In making these allegations, and encouraging the Court to look at the totality of the circumstances, the Plaintiffs noted that: (a) as of the 2010 census, the City was 53.7% white and 44.8% Black, (b) the Black voters in the City were geographically compact enough to form a majority of the voting age population in at least three (of the five) City council districts, (c) no Black candidate had ever been elected to City council at that point in time, (d) Black voters were politically cohesive when voting for City council members, (e) white voters in the City tended to vote as a bloc against Black candidates, and (f) the City had a history of racial discrimination in voting, education, housing and other areas. 

On April 2, 2019, the court dismissed the claims against the members of City council and the mayor of the City, which had been brought by Plaintiffs against those individuals in their official capacities.  In reaching this conclusion, the Court found those claims to be entirely duplicative of the claims made by Plaintiffs against the City.  In the same order, the Court also dismissed the claim that the At-Large Voting Method violated the Fifteenth Amendment of the U.S. Constitution.  In reaching this conclusion, the Court concluded that vote dilution is not a cognizable claim under the Fifteenth Amendment, which protects the right to register to vote and to vote.

The Court referred the case to mediation on July 12, 2019.  On July 25, 2019, the parties filed a joint motion for settlement and entry of a Consent Decree.  Before the Court ruled on the motion, the Attorney General of Alabama filed an Amicus Curiae brief in the case requesting a 20 year end date to the proposed Consent Decree, primarily because cumulative voting is "not the State of Alabama's preferred method of election." As noted below, the Court did not adopt this recommendation.  

On October 11, 2019, a Consent Decree was approved by the Court pursuant to which the City agreed to use cumulative voting when electing its City council members beginning with the municipal election scheduled for August of 2020. Under the cumulative voting method, each voter was given five votes to use for the City council elections. Such voter could choose to use one vote for each of the five City council positions, all five votes for one candidate for City council, or any combination in between. The Court has retained jurisdiction over the case solely to enforce the Consent Decree, which has no specific end date.
