On November 12, 2018, three Plaintiffs--a veterans' voters' rights group, the Democratic National Committee, and Democratic Senatorial Campaign Committee--filed suit against the Florida Secretary of State in the US District Court for the Northern District of Florida, challenging the application of Florida law that required domestic mail-in ballots to be rejected if they were not received by the supervisor of elections by 7 p.m. on Election Day.  After Senior Judge William Stafford recused, the case was reassigned to District Judge Mark Walker.  Plaintiffs alleged 42 USC 1983 claims and sought declaratory and injunctive relief, alleging their First Amendment and Equal Protection rights were violated by the burdens placed by the Election Day receipt requirement, which did not apply to overseas mail-in ballots.  The case was filed against a backdrop of a hotly contested US Senate race in which incumbent Democratic Senator Bill Nelson ultimately was defeated by Republican Rick Scott. 

Plaintiffs filed an emergency motion for temporary restraining order and preliminary injunction, seeking to require Defendant and those acting under his supervision be to count mail-in ballots that were postmarked prior to Election Day and received within 10 days after Election Day. Florida applied a similar 10-day rule to overseas mail ballots; thus, Plaintiffs argued, it would not create an administrative burden. Plaintiffs submitted declarations of a voter whose mail-in ballot was not counted and of a former county elections supervisor who described reasons for delay in receipt of mail-in ballots and proffered that the proposed 10-day rule was administratively feasible. 

The following parties sought, and the Court granted, leave to intervene in opposition to Plaintiffs' motion: the National Republican Senatorial Committee (NRSC), Republican Party of Florida, and Florida Attorney General.

Defendant and Intervenors opposed the expedited relief sought by Plaintiffs, including because the law at issue had been on the books for decades, yet Plaintiffs waited until after the election to bring a facial challenge; the law had been upheld previously; and the deadline was non-discriminatory and imposed a minimal burden on voters. The NRSC also asserted a laches defense and that the Fifth Circuit case  Toney v. White requires parties having grievances to bring them prior to an election for pre-election adjudication. 

The court held an evidentiary hearing on November 15, 2018, and then denied a preliminary injunction on November 16, 2018. The court rejected the laches argument because Plaintiffs were seeking prospective relief and rejected the Toney-elections-diligence defense because Toney requires defendants to show by clear and convincing evidence that there was a deliberate bypass of a pre-election judicial remedy.  The court then found Plaintiffs had not shown a likelihood of success on the merits of their claims because (1) the deadline was a reasonable means of achieving the state's important regulatory interest in delineating finality in elections; and (2) the 10-day rule for overseas ballots did not violate domestic voters' right to equal protection; rather, it was a federally mandated exception intended to ensure that overseas voters have the same right to vote as domestic voters. 

On November 19, 2018, the court directed the Secretary of State to supply the court with information from all 67 counties listing the number of non-overseas mail-in ballots that were postmarked before but received after Election Day and therefore not counted, by November 30, 2018, and to update the Court once per week until information from all 67 counties was included.  The Secretary of State complied with that order.  Plaintiffs initially informed the court they intended to proceed with the litigation but then filed a notice of voluntary dismissal without prejudice on January 18, 2019. 

The court closed the case, and the Clerk entered judgment of dismissal without prejudice on January 22, 2019.
