This case, which arose in the context of Florida’s closely contested 2018 U.S. Senate election, challenged Florida’s signature-matching requirements for vote-by-mail and provisional ballots as disenfranchising Florida voters, including a disproportionate number of young and first-time voters and racial and ethnic minorities.  On November 8, 2018, Plaintiffs, the Democratic Executive Committee of Florida (DECF) (a statewide organization representing Democratic candidates and voters) and the political campaign for Democratic U.S. Senate candidate Bill Nelson, represented by private counsel, filed suit in the U.S. District Court for the Northern District of Florida, under 42 U.S.C. § 1983 and 28 U.S.C. §§ 2201 and 2202, alleging that Florida’s practice of rejecting vote-by-mail ballots with signatures that did not match their ballot envelopes based on a standardless signature matching process, with a deadline to submit a “cure” affidavit by 5 p.m. one day before the election, and requiring persons casting provisional ballots to present evidence supporting their eligibility to vote by 5 p.m. two days following the election (1) unduly burdened the right to vote in violation of the First Amendment and Equal Protection clause, and (2) violated the Equal Protection clause because Florida counties applied differing standards to the signature matching process, resulting in the disparate treatment of similarly situated voters including racial minorities and young voters.   Plaintiffs sought injunctive and declaratory relief.  Concurrently with the Complaint, Plaintiffs filed a motion for temporary restraining order and preliminary injunction, seeking to enjoin the Florida Secretary of State and those under his supervision, direction, or control from rejecting vote by mail and provisional ballots on the basis of a signature mismatch.  Plaintiffs also requested that the Court toll the deadline for the county canvassing boards to submit unofficial results to the Department of State until the matter could be heard. The case initially was assigned to U.S. District Judge Robert Hinkle. 

The Court allowed the National Republican Senatorial Committee (NRSC) and Florida’s Attorney General to intervene in the litigation. 

The deadline for county canvassing boards to submit unofficial results to the Department of State was noon on Saturday, November 10, 2018.  Judge Hinkle found that even if votes were unconstitutionally rejected by the November 10 deadline, the Court would be able to remedy the violation, and thus scheduled a hearing for November 14, 2018.  Judge Hinkle then disqualified himself, and the case was reassigned to Chief Judge Mark Walker.

Defendants opposed the motion for TRO on numerous grounds, including that Plaintiffs brought their claims too late, as the vote-by-mail statute had been amended in 2017 to address concerns the Court had raised in previous litigation (by adding a cure provision), and Plaintiffs waited until after the 2018 election to challenge it; the signature-matching requirements were reasonable, politically neutral regulations that satisfied the Anderson-Burdick framework; and there was no evidence of discriminatory intent as required for an equal protection violation. The Secretary argued that the claims were barred by res judicata because the Florida Democratic Party did not continue to pursue litigation after the 2017 amendment added the cure provision, and the revised statute eliminated any constitutional defect. 

After holding an evidentiary hearing, Judge Walker granted a preliminary injunction on November 15, 2018. 347 F.Supp.3d 1017.  He first concluded that Plaintiff DECF had standing, including based on the affidavits of four voters who received notice that their mail-in ballots were rejected after it was too late to cure.  He rejected Defendants’ laches argument and found that res judicata did not bar Plaintiffs’ claims both because Senator Nelson’s campaign was a new party and the statute had been amended since the prior lawsuit. He concluded that, according to Toney v. White, plaintiffs were not required to raise a pre-election challenge because plaintiffs weren’t seeking to void an election (a recount was ongoing), and it was not obvious that the opportunity to cure provided in the 2017 statutory amendment was “woefully inadequate” until the election played out and voters who submitted timely mail-in ballots were informed of the rejection of their votes after it was too late to cure.  He also called it “shocking” that Florida law does not allow a voter to challenge a vote rejected as illegal, but any voter or candidate could challenge a vote accepted as legal.  He ordered the supervisors of elections to allow voters who had been belatedly notified that they submitted a mismatched-signature ballot to cure their ballots by November 17, 2018, at 5 p.m.

Defendants immediately appealed, and the NRSC filed an emergency motion to stay the district court order and to expedite the appeal. (Eleventh Circuit Case No. 18-14758).  The same day, the Eleventh Circuit Court of Appeals denied the motion to stay and expedite, noting that one judge dissented and a written opinion would follow. 

The Secretary moved to hold the district court case in abeyance while the appeal proceeded.  The District Court denied that motion. (Doc. 91.) 

Defendants then filed a joint motion to dismiss the Complaint for failure to state a claim.  (Doc. 97.)

Plaintiffs filed a First Amended Complaint (Doc. 100), adding as Plaintiffs the DNC Services Corporation / Democratic National Committee (DNC) and DCC a/k/a democratic Congressional Campaign Committee, and adding a claim for violation of procedural due process.

On February 15, 2019, the Eleventh Circuit Court of Appeals issued a lengthy opinion giving its reasons for denying the NRSC’s motion for emergency stay. The majority concluded the NRSC failed to make a strong showing of likelihood of success on appeal, including because the signature mismatch provisions imposed a burden on the right to vote and were unlikely to satisfy the Anderson-Burdick test because Florida had not enacted uniform standards for matching signatures nor created qualifications or training for those engaged in the job, and the cure provision was ineffective because many voters would not learn their votes would not be counted until it was too late to do anything about it. Florida had not shown that its interests (fraud prevention, orderly election administration, and fundamental fairness and protecting public confidence in the legitimacy of the election) justified depriving voters of the ability to cure signature mismatch in a timely fashion.  The court also found the NRSC was unlikely to succeed on its laches argument, without deciding whether laches applies to bar prospective relief from constitutional harms.  The NRSC also failed to show irreparable injury, as the district court’s order set forth a manageable, time-sensitive process, and the threat of penalty of perjury safeguarded against false claims of belated notification, and the possibility of forcing defendants to expend unrecoverable resources to encourage voters to cure their ballots was not enough to overcome NRSC’s inability to show likelihood of success on the merits.  Judge Gerald Tjoflat penned a lengthy dissent, finding that the district court had improperly reframed Plaintiffs’ claims and violated principles of federalism. 

On May 6, 2019, the District Court entered an Order identifying pending legislation regarding election administration and ordered the parties to file memoranda detailing what effect, if any, the legislation had on the matter within 10 days of the governor signing it. (Doc.128.)

On July 1, 2019, Defendants responded to the Order regarding pending legislation by filing a motion for judgment on the pleadings, arguing that the case should be dismissed because the legislation (SB 7066) addressed the issues raised in Plaintiffs’ Complaint in four ways: (1) it created a uniform standard for determining whether a signature should be rejected as a mismatch; (2) it required supervisors of elections and county canvassing boards to undergo “formal signature matching training” provided by the Secretary of State, (3) it amended the cure procedures and deadlines to ensure that all vote-by-mail and provisional voters have a meaningful chance to cure a mismatched signature up until 5 p.m. on the second day after the election; and (4) it modified Florida’s election-contest provisions to allow Florida circuit courts to consider the identification the voter provided with the cure affidavit in addition to the signatures provided. (Doc. 141.) 

On July 2, 2019, Plaintiffs moved to dismiss without prejudice in view of the legislative amendment.  (Doc. 143.) 

On July 29, 2019, the District Court granted Plaintiffs’ motion for voluntary dismissal without prejudice (Doc. 149), and the Clerk entered final Judgment of dismissal without prejudice (Doc. 150). 

The Secretary of State and Attorney General moved to voluntarily dismiss their appeals, which the Eleventh Circuit Court of Appeals granted on August 13, 2019. 

The NRSC maintained its appeal and asked the Eleventh Circuit to vacate the district court’s preliminary injunction order as well as the Eleventh Circuit’s prior stay-panel opinion because mootness prevented review of the decision on appeal. The Eleventh Circuit declined to vacate the preliminary orders because its precedent held that appellate stay orders are not a final adjudication of the merits and therefore have no res judicata effect. The court also declined to vacate the district court opinion based on the usual practice to dismiss an appeal as moot without vacating the ordered appealed from. 

The case appears closed.

ORDER GRANTING PRELIMINARY INJUNCTION. Plaintiffs' Motion for Preliminary Injunction, ECF No. 3, is GRANTED. Defendant Detzner is ordered to issue a directive to the supervisors of elections (with this Order attached) advising them (1) Florida's statutory scheme as it relates to curing mismatched-signature ballots has been applied unconstitutionally; and (2) in light of this Court's order, they are required to allow voters who have been belatedly notified they have submitted a mismatched-signature ballot to cure their ballots by November 17, 2018, at 5:00 p.m. The supervisors of elections shall allow mismatched-signature ballots to be cured in the same manner and with the same proof a mismatched-signature ballot could have otherwise been cured before November 5, 2018, at 5:00 p.m. The preliminary injunction set out above will take effect upon the posting of security in the amount of $500 for costs and damages sustained by a party found to have been wrongfully enjoined. Plaintiffs will immediately notify Defendant when the bond has been posted and thereafter immediately file proof of such notice through the electronic case files system. Likewise, upon receipt of the notice of the posting of security, Defendant shall notify this Court whether he intends to comply with this Order by filing a notice through the electronic case files system on or before 5:00 P.M. on November 15, 2018.
