On November 7, 2018, an individual formerly held as a federal pre-trial detainee at a privately operated prison filed a complaint in the U.S. District Court for the District of Kansas against a private prison company and the prison's warden, alleging that she was deprived of her rights to due process and equal protection when she was not permitted to vote - either in-person or absentee - in the 2016 general election. Plaintiff brought suit under 42 U.S.C. 1983, seeking damages and declaratory and injunctive relief. She sought to certify a class of individuals held at the prison on November 8, 2016, who were U.S. citizens, residents of Kansas, at least 18 years of age, were not serving a sentence for conviction of a felony crime, had not previously voted in the 2016 election, were provided neither absentee ballot nor transportation to a voting center, and were registered to vote or had been denied the opportunity to register to vote while held at the prison.
On February 18, 2019, before any defendant had appeared, plaintiff voluntarily dismissed the case without prejudice.
