A pro se plaintiff filed a complaint against the State of Alabama Department of the Secretary of State Election Committee, claiming violations of the Civil Rights Act, in the U.S. District Court for the Northern District of Alabama on August 21, 2018. Plaintiff claimed his affirmative action rights were violated because he did not have a chance to be on the ballot for the office of governor of Alabama. He believed that the Republican-controlled state government had rigged the state election process against a non-white, independent candidate such as himself. He sought the governor position and federal government regulation of the state election process.
On October 18, 2018, the District Court dismissed his case without prejudice due to a finding that the claim lacked basis in either law or fact, given that the facts showed he took none of the necessary steps to be included on the ballot for the governor race. The Plaintiff appealed to the U.S. Court of Appeals for the Eleventh Circuit, which also dismissed the case on December 18, 2018 for want of prosecution because the Plaintiff failed to pay required filing and docketing fees.
