On September 13, 2018, the City of Stockbridge, Georgia (“Stockbridge”), the Urban Redevelopment Agency of the City of Stockbridge (“Stockbridge URA”), and two Voter Plaintiffs (collectively, “Plaintiffs”) filed this lawsuit in the United States District Court for the Northern District of Georgia, Atlanta Division. Plaintiffs sued the Henry County Elections and Registration Director and Members of the Henry County Board of Elections and Registration under 42 U.S.C. Section 1983 for violation of the Contract Clauses of the U.S. and Georgia Constitutions. Represented by the firm Balch & Bingham, LLP, Plaintiffs sought a preliminary injunction to prevent the upcoming referendum and the certification of the results, pending a trial on the merits of their claims. This case was assigned to Judge Leigh Martin May.

First, Plaintiffs alleged that the proposed de-annexation would dilute African-American voting strength and was racially motivated, violating Section 2 of the Voting Rights Act of 1965. Second, Plaintiffs claimed that the de-annexation violated the Contract Clause and the Fourteenth Amendment of the U.S. Constitution, as it would impair the city’s ability to fulfill bond obligations and weaken minority voting power. Finally, Plaintiffs argued that the de-annexation would have a financial impact, as it would significantly reduce Stockbridge’s revenue, forcing it to impose property taxes and potentially default on bond obligations.

On September 13, 2018, Plaintiffs filed an amended complaint citing these allegations. The amended complaint sought injunctive relief to prevent the de-annexation and protect the plaintiffs’ rights under federal law and the Constitution.

On September 13, 2018, Plaintiffs filed a motion for preliminary injunction and a memorandum in support of their motion for preliminary injunction. The memorandum discussed the likelihood of success on the merits because the de-annexation acts would have financial, contractual, and constitutional implications. Financially, the City of Stockbridge’s ability to repay $17 million in bond obligations would be impaired, significantly reducing Stockbridge’s commercially property and revenue base. Not only would Stockbridge’s ability to repay the bonds be at risk, but so would its ability to borrow money in the future. Constitutionally, Plaintiffs argue that the de-annexation acts violate contractual obligations under both state and federal constitutions because the acts detrimentally affect the financial framework under the original bond purchase agreement without providing an alternative to relieve bond indebtedness. The acts would reduce Stockbridge’s available tax base and reduce the powers of its municipal corporation. The repeal of such security provisions against economic fluctuations impairs a contractual obligation.

Additionally, the memorandum claimed there was no significant and legitimate purpose behind the acts. The acts did not remedy any general social or economic problem and were therefore unconstitutional. The memorandum also discussed the irreparable injury Plaintiffs would suffer without the injunction, the absence of injury to Defendants, as well as the absence of harm to the public interest. The memorandum requested the Court to enjoin Defendants from taking any action to implement the acts until the merits of Plaintiffs’ claims could be assessed.

On October 18, 2018, the court denied the motion for preliminary injunction.

On November 1, 2018, Plaintiffs filed a third amended complaint requesting a temporary restraining order, preliminary injunction, and permanent injunction enjoining Defendants from administering or implementing the de-annexation acts.

The case was dismissed without prejudice on November 15, 2018. The reasons for the dismissal are unknown to the Clearinghouse at this time.
