Plaintiff was a registered New York voter who intended to wear political buttons expressing support for his favored candidates and/or conservative causes and carry political placards into the polling place. Plaintiff was prohibited from wearing political buttons or carrying political placards into a polling place under N.Y. Elec. Law §§ 8-104(1) and 17-130(4), (23). 

On August 3, 2018, plaintiff filed a complaint in the United States District Court for the North District of New York, and argued that (1) the prevention of wearing buttons and carrying political placards within one hundred feet of the entrance of a polling place and (2) the prevention of wearing political clothing within a polling place violates the First Amendment rights to free speech and freedom of association under 42 U.S.C. § 1983. Defendants were members of the New York State Board of Elections and Commissioners on the Onondaga County Board of Elections. Plaintiff was seeking (1) a ruling that these statutes are facially unconstitutional, (2) declaratory judgment that N.Y. Elec. Law §§ 8-104(1) and 17-130(4), (23), as applied to political buttons or placards, violated the First Amendment, (3) a permanent injunction prohibiting the New York State Board of Elections, the Commissioners of the Onondaga County Board of Elections, and all Defendants’ agents and successors, from enforcing N.Y. Elec. Law §§ 8-104(1) and 17-130(4) and (4) preliminary injunctive relief as the upcoming election Plaintiff would have voted in would occur on November 6, 2018.  The case was assigned to Judge Gary L. Sharpe. 

Plaintiff filed a motion for Summary Judgment on October 24, 2018, with Defendants filing a motion for Summary Judgment on October 26, 2018. On May 24, 2019, U.S. Magistrate Judge David E. Peebles issued a Report and Recommendation on Plaintiff's claims, particularly focused on Plaintiff's reliance on the case Minnesota Voters’ Alliance v. Mansky, 138 S. Ct. 1876 (2018), in which the United States Supreme Court determined that the State of Minnesota's so-called "political apparel ban" failed to withstand a First Amendment challenge. The Report and Recommendation supported Defendants' motion for Summary Judgment and argued New York's laws are unambiguous and do not suffer from the infirmities discerned by the Supreme Court in Minnesota Voters' Alliance. Following the Report and Recommendation, judgment was issued in favor of the Defendants on September 26, 2019, with the Report and Recommendation being adopted in its entirety and the Plaintiff's complaint being dismissed.
