This is a case about counting incarcerated individuals as residents of the district where they are imprisoned for the purpose of legislative redistricting.

On June 28, 2018, the NAACP, the NAACP Connecticut State Conference, and five NAACP members filed this lawsuit in the U.S. District Court for the District of Connecticut. The plaintiffs sued Connecticut’s Secretary of State and Governor in their official capacity under the Fourteenth Amendment of the U.S. Constitution and 42 U.S.C. § 1983. They claimed that Connecticut’s 2011 state legislative redistricting plan was based on unlawful prison gerrymandering, violating the “one person, one vote” requirement of the Fourteenth Amendment. The plaintiffs defined prison gerrymandering as the practice of counting the location of the prison as the prisoner’s residence, instead of the pre-incarceration address for the purpose of drawing state legislative districts. The plaintiffs argued that this practice disproportionately affected minority communities and violated their constitutional voting rights. The plaintiffs sought declaratory and injunctive relief, as well as reasonable attorneys’ fees. They sought injunctive relief to enjoin the defendants from conducting elections under the 2011 redistricting plan. If this failed, the plaintiffs requested a court-ordered redistricting plan. The case was initially assigned to Judge Warren W. Eginton.

On September 6, 2018, the defendants filed a motion to dismiss, arguing that the District Court lacked jurisdiction under the Eleventh Amendment and the plaintiffs’ claim constitutes a nonjusticiable political question. The District Court denied the defendants’ motion on February 15, 2019.

On March 7, 2019, the defendants appealed the District Court’s decision and filed a motion to stay, which was granted by the Second Circuit Court of Appeals.

On September 24, 2019, the Court of Appeals affirmed in part the District Court’s Eleventh Amendment decision and remanded the case back to the District Court, directing that future proceedings be conducted by a three-judge court.  2019 WL 4616716

On September 26, 2019, the case was reassigned to Judge Janet Bond Arterton.

The Parties filed a joint stipulation of dismissal on April 14, 2020, which the District Court approved on April 16, 2020.
