Plaintiffs, all residents of and registered voters in Massachusetts, filed a lawsuit against the Governor of Massachusetts and the Secretary of the Commonwealth of Massachusetts in the U.S. District Court for the District of Massachusetts on February 21, 2018.  In their complaint, plaintiffs alleged that Commonwealth’s winner-take-all method (the “WTA system”) for selecting electors for the president and vice president per Mass. Gen. Laws ch. 53, § 8 & ch. 54, §§ 43, 118, and 148 (2017) violated the “one person, one vote” principle protected by the Equal Protection Clause of the Fourteenth Amendment and that the WTA system severely burdened their First and Fourteenth Amendments rights to associate through voting.  In general terms, the WTA system awards the candidate who receives more votes than any other candidate with all of the Commonwealth’s electors, who then proceed to vote in the Electoral College.  Here, Plaintiffs argued that the effect of the WTA system in Massachusetts was that votes for the losing candidates are therefore not counted at all.  Plaintiffs’ complaint requested that the District Court declare the WTA system unconstitutional.  The case was assigned to Judge Patti B. Saris. On the same day, Plaintiffs’ counsel filed parallel lawsuits on behalf of voters in California, South Carolina, and Texas that similarly challenged the WTA system as applied in those states.  

On May 21, 2018, the defendants filed a motion to dismiss for lack of standing and for failure to state a claim.  In their motion and supporting memorandum, the defendants argued that plaintiffs failed to establish a concrete or particularized injury-in-fact nor did plaintiffs’ claims violate the Equal Protection Clause because, under the WTA system, every vote is still given equal weight in determining which candidate receives the most votes.  Following a hearing on December 7, 2018, the District Court granted defendants’ motion to dismiss.
