This case challenged Indiana's Lake County Precinct Consolidation Law ("LCPCL") as unfairly targeting a majority-minority voting district in Indiana. The LCPCL targeted only one of Indiana’s 92 counties, which was home to a substantial portion of the state’s minority population, and sought to consolidate or eliminate 294 of Lake County Indiana’s 555 election precincts.  

On August 9, 2017, Plaintiffs, the Indiana State Conference of the NAACP along with named voters, alleged the newly enacted Indiana Senate Bill 220, known as LCPCL, violated Section 2 of the Voting Rights Act, 52 U.S.C. 10301 along with the First, Fourteenth and Fifteenth Amendments of the United States Constitution. 

Plaintiffs alleged that the impact of the LCPCL would cause voter confusion and force voters to travel longer distances to vote, which would be a severe burden for voters who are least likely to bear such burden. Many voters in the district are elderly, disabled, have low education, little to no access to transportation, and are unable to easily adapt to changes in polling location or even know their polling place has changed. In addition, Plaintiffs alleged that because the LCPCL did not require election officials to notify voters of their new precinct or voting location, voters would likely not be aware of the changes until they attempt to vote at their old polling location. Plaintiffs further alleged that the reduction in number of polling locations would likely increase lines at the polling and voting time. Plaintiff also alleged that the LCPCL would reduce the number of precinct committee persons in Lake County, reducing the minority representation and directly reducing the influence of minority voters. Plaintiffs further argued that the consolidation plan arbitrarily picked a 600 “active” voter threshold for consolidation, and that at a 500 active voter threshold, the impact would be significantly less and approximately 100 fewer precincts would be eliminated.

Represented by private counsel, Plaintiffs sought declaratory and injunctive relief enjoining Defendants, their agents, and successors in office, from enforcing the LCPCL. 

During the pendency of the case, the entities charged with adopting the precinct consolidation plan for Lake County failed to adopt or implement a plan by the statutory deadlines.  As a result, the Indiana legislature passed House Bill 1383, which amended the law, changed the process for adoption and implementation of a precinct consolidation plan and extended the deadlines. Plaintiffs filed a motion to stay the proceedings given the new process and deadlines, which Defendants opposed.  Plaintiffs ultimately agreed to stipulate to a dismissal of the case without prejudice, which was granted.
