On June 14, 2017, the plaintiff filed this putative class action lawsuit in the U.S. District Court for the Eastern District of Arkansas on behalf of himself and all similarly situated citizens of the City of Helena-West Helena, Arkansas. Represented by private counsel, the plaintiff sued the City of Helena-West Helena and its mayor and aldermen, each in their individual and official capacities This case was initially assigned to Judge Billy Roy Wilson but was reassigned to Judge James Leon Holmes on June 22, 2017. 

In September 2016, after obtaining the requisite number of signatures, the plaintiff filed a petition to initiate an ordinance that would reduce the number of wards in Helena-West Helena from five to three and, consequently, reduce the number of city council members from ten to six. This ordinance passed by majority vote at the November 2016 election. However, in December 2016, this ordinance was voided by the city council, which adopted a repeal ordinance that took immediate effect.

In the complaint, the plaintiff claimed this repeal ordinance violated the First, Fourth, Fifth, and Fourteenth Amendments of the U.S. Constitution as well as myriad Arkansas state laws and petitioned the court to, among other things, declare the initiated ordinance valid and award costs, fees, and expenses associated with the litigation. The parties subsequently exchanged various motions, amendments, responses, and replies, including plaintiff's Motion for Temporary Restraining Order and Preliminary Injunction, defendants' Motion to Dismiss for Failure to State a Claim, and defendants' Motion to Disqualify Counsel.

On August 25, 2017, Judge Holmes issued an Opinion and Order granting defendants' Amended Motion to Dismiss, denying as moot both defendants' Motion to Disqualify Counsel and plaintiff's Motion for Temporary Restraining Order and Preliminary Injunction, and, ultimately, dismissing the case without prejudice. Given the plaintiff did not even allege diversity jurisdiction, Judge Holmes based his decision on two basic principles: (i) that a federal court lacks subject matter jurisdiction when a plaintiff fails to state a claim arising under federal law and (ii) that a plaintiff lacks standing when the plaintiff fails to allege injury that is sufficiently particular to him or a discrete group. Judge Holmes explained that, here, the court did not have subject matter jurisdiction because the "heart" of the plaintiff's complaint was violations of state law and his few allegations of federal law violations were made in a "conclusory fashion" without explanation or backing. Furthermore, Judge Holmes explained that the plaintiff lacked standing because he failed to demonstrate any "concrete and personalized injuries" or "particularized stake in the litigation," instead admitting that all citizens of Helena-West Helena were similarly injured by the repealed ordinance.

The plaintiff has not filed any objections or appeals following the Judgment entered by Judge Holmes on August 25, 2017.
