This is a case alleging that neither major candidate for the 2016 presidential election was qualified to hold the office of the President.
On November 1, 2016, an individual plaintiff filed this lawsuit pro se in the United States District Court, Western District of New York on behalf of herself and all those similarly situated. The plaintiff sued the 2016 Republican and Democratic candidates for president. Plaintiff raised concerns that neither candidate was qualified to be president and argued that the 2016 presidential election should be postponed until “serious, qualified, trustworthy” persons could be sought and elected to fulfill the position of President. Plaintiff alleged violations of due process, equal protection, and the right to counsel. Plaintiff sought injunctive relief to postpone the general election, keep President Obama in office until a new candidate could be found, and to give plaintiff time to gather signatories in favor of the injunction.
On November 8, 2016, a judgment in favor of the defendants was entered.
