On October 30, 2016, eight days before Election Day, the Plaintiff (Nevada State Democratic Party) filed a complaint in the United States District Court for the District of Nevada pursuant to which the Plaintiff alleged that the Defendants, the Nevada Republican Party (“NRP”), Stop the Steal Inc., and Donald J. On October 30, 2016, eight days before Election Day, the Plaintiff (Nevada State Democratic Party) filed a complaint in the United States District Court for the District of Nevada pursuant to which the Plaintiff alleged that the Defendants, the Nevada Republican Party (“NRP”), Stop the Steal Inc., and Donald J. Trump for President, Inc., among other, coordinated a campaign of vigilante voter intimidation to prevent minority voters in urban neighborhoods from voting in the 2016 election which violated the Ku Klux Klan Act of 1871 and the Voting Rights Act of 1965.

More specifically, the Plaintiff alleged that in the months leading up to the 2016 election (i) Donald J. Trump (“Trump”) made an escalating series of statements, often racially tinged, suggesting that his supporters should go to particular precincts on Election Day and intimidate voters, (ii) Trump’s vice presidential running mate, Mike Pence, joined in calling for Trump supporters to engage in voter intimidation, (iii) one particular Trump associate amplified Trump’s message and called for the execution of certain high profile politicians and other public figures, (iv) Super PAC Stop the Steal actively recruited Trump supporters for “exit polling,” specifically targeting nine Democratic-leaning cities with large minority populations, including Las Vegas, and (v) Trump and his campaign coordinate closely with the NRP on a wide variety of matters, including overall campaign strategy, public messaging, voter outreach, and field operations. In addition, the complaint alleged that the available evidence suggested that Trump’s supporters were responding to his calls to engage in voter intimidation. Based on the allegations, the Plaintiff sought immediate temporary relief enjoining defendants from organizing efforts to engage in voter intimidation. 

In Count I, the Plaintiff asked that the court (i) declare that the Defendants and their co-conspirators violated the Ku Klux Klan Act through their conspiracy to intimidate voters and (ii) issue an injunction enjoining Defendants and others from any further activity to advance their conspiracy.

In Count II, the Plaintiff asked the court to declare that the Defendants and their co-conspirators violated Section 11(b) of the Voting Rights Act.

In Count III, the Plaintiff asked the court to issue an injunction enjoining the Defendants and others from any of their contemplated voter-intimidation activity. 

On November 9, 2016, on the day after the election, the Plaintiff moved to voluntarily dismiss the case.

The case is now closed.
