On October 9, 2026, the Florida Democratic Party ("Plaintiff") filed a complaint for emergency injunctive and declaratory relief against the Governor of the State of Florida and the Secretary of State of the State of Florida (collectively, "Defendants"). The complaint alleged that under state law, the voter registration deadline for Florida voters was Tuesday, October 11, 2016. Florida voters, at the time, faced a daunting and life-threatening obstacle to registering to vote in the form of Hurricane Matthew. On October 6, Defendant Scott ordered Florida citizens to evacuate the areas in the hurricane's path. That same day, Defendant Scott refused to extend the voter registration deadline for the very citizens heeding his orders to evacuate - forcing voters to choose between their safety and the safety of their families, on one hand, and their fundamental right to vote, on the other. Plaintiffs brought this action under 42 U.S.C. 1983 and 1988 to redress the deprivation under color of state law of rights secured by the US Constitution (First Amendment, Equal Protection Clause), and Section 2 of the Voting Rights Act. The plaintiff sought declaratory and injunctive relief. The case was assigned to Judge Mark E. Walker.

The same day, the plaintiff filed a motion for a temporary restraining order to extend the voter registration deadline. 

Ultimately, the court granted the Plaintiff a Temporary Restraining Order, as they concluded that Defendants' failure to extend the voter registration deadline is likely unlawful as an undue burden on the right to vote, in violation of the First Amendment and the Equal Protection Clause of the Fourteenth Amendment and 42 U.S.C. 1984 and/or a violation of Section 2 of the Voting Rights Act. The court further ordered a preliminary injunction on October 12, 2016 to ensure the voting registration deadline was extended.

The case is now closed.
