This case is about the Georgia Secretary of State and Chief Election Official refusing plaintiff’s request that he make publicly available certain records concerning his processes and reasons for rejecting, canceling, or not adding voter registration applicants to Georgia’s official list of eligible voters ahead of the 2014 United States midterm elections. The defendant did not comply with the requirements of the National Voter Registration Act of 1993 (“NVRA”) and the plaintiff was not able to perform public oversight functions made possible by the NVRA as a result.

On July 6, 2016, the plaintiff filed its complaint in the United States District Court for the Northern District of Georgia Atlanta Division against the Georgia Secretary of State and Chief Election Official. The plaintiff claimed that the defendant’s refusal to comply with the requirements of the NVRA by providing the voter registration records requested by the plaintiff prevented the plaintiff from performing critical oversight mandated by the NVRA, prevented the plaintiff from assisting and educating applicants who were rejected or canceled with registering to vote in time for the midterm and general elections. Represented by private counsel, the plaintiff sought equitable and declaratory relief to make the records requested by the plaintiff available free of cost and the plaintiff sought preliminary relief to obtain relief in a timely manner prior to the 2016 general elections. The case was assigned to Judge William S. Duffey.

On July 13, 2016, the plaintiff filed a motion for preliminary injunction to order the defendant to make the voter registration records requested by the plaintiff available by August 1, 2016 with updates following over the next few months thereafter. Furthermore, the plaintiff requested that the court treat this as an emergency motion and be given expedited consideration because of the upcoming 2016 general elections.

On August 3, 2016, the defendant filed a motion to dismiss because he alleged that the plaintiff sought unfettered access to the statewide voter registration database and he alleged that the NVRA did not require public inspection of the statewide voter registration database and the Help America Vote Act prohibited this type of unauthorized access.

On August 3, 2016, the defendant filed a motion to stay all discovery related activities pending the court’s resolution of the motion to dismiss filed by the defendant.

On August 9, 2016, the plaintiff filed a motion for limited expedited discovery to clarify and address defendant’s factual claims in order to resolve plaintiff’s pending motion efficiently. The plaintiff requested that the court direct defendant to make available the individual who was most knowledgeable about the Georgia voter database maintained by the defendant or under the authority of his office.

On August 12, 2016, the court issued an order that granted plaintiff’s motion for expedited discovery and limited the deposition to the categories set forth in this order. Additionally, the court denied as moot defendant’s motion to stay all discovery related activities.

On September 20, 2016, the court issued an opinion and order that denied defendant’s motion to dismiss and that granted in part and denied in part plaintiff’s motion for preliminary injunction. Defendant was required to disclose to the plaintiff certain limited records outlined in this order with respect to canceled, rejected, or pending voter applicants.

On January 13, 2017, the defendant filed a motion to dismiss for lack of jurisdiction because the plaintiff’s claims for declaratory and injunctive relief were moot and should be dismissed.

On April 14, 2017, the plaintiff and the defendant jointly filed a joint notice of settlement in principle confirming that the parties were negotiating and finalizing the language of the final settlement agreement and anticipated executing it soon.

On April 17, 2017, the court issued an order acknowledging the fact that the plaintiff and the defendant filed a joint notice of settlement and confirming that the court removed this case from its calendar and directed the clerk of court to close the case administratively unless the parties did not conclude the final settlement.

On June 1, 2017, the parties filed a stipulation of dismissal as promised since they reached final settlement and requested that the action be dismissed with prejudice.

On June 2, 2017, the clerk of court entered the dismissal with prejudice.

This case is closed.
