This is a case about conducting reasonable voter list maintenance for elections and producing records and data related to those efforts. On June 27, 2016, a registered voter in Broward County and member of the American Civil Rights Union, Inc., (ACRU), and the ACRU filed this lawsuit in the United States District Court for the Southern District of Florida Fort Lauderdale Division. The case was assigned to Judge Beth Bloom.

The Plaintiffs sued the Supervisor of Elections of Broward County, Florida under Section 8 of the National Voter Registration Act of 1993 (NVRA). Represented by private counsel and public counsel, the Plaintiffs sought injunctive relief requiring Defendant to permit inspections of election records pursuant to the NVRA and declaratory and injunctive relief requiring Defendant to conduct and execute reasonable voter list maintenance programs to ensure that only eligible voters are registered to vote. Plaintiffs sued on two grounds: Count I for failing to making reasonable efforts to conduct voter list maintenance programs and Count II for failing to adequately respond to Plaintiffs' request for data.

On July 20, 2016, Defendant Snipes filed a first motion to dismiss for lack of subject matter jurisdiction pursuant to Federal Rules of Civil Procedure (FRCP) 12(b)(1) and for failure to state a claim upon which relief may be granted pursuant to FRCP 12(b)(6). However, on August 4, 2016, Plaintiffs filed a first amended complaint adding an attorney and minimally modifying language in the original complaint. This rendered Defendant Snipes' first motion to dismiss as moot. On August 18, 2016, Defendant Snipes filed a second motion to dismiss for lack of subject matter jurisdiction pursuant to FRCP 12(b)(1), for failure to state a claim upon which relief may be granted pursuant to FRCP 12(b)(6), and for failure to follow the proper notice procedures of 42 U.S.C. §1973gg-9(b)(2).

Then, on September 19, 2016, United Healthcare Workers East filed a motion to intervene as a Defendant due to concern over the protection of its interests. The Court granted this motion to intervene on September 20, 2016.

On September 21, 2016, Defendant United Healthcare Workers East (UHWE) filed a motion to dismiss Count I of Plaintiff's Amended Complaint for failure to state a claim upon which relief may be granted pursuant to FRCP 12(b)(6). UHWE argued that Plaintiffs' claim that Defendant Snipes failed to use reasonable efforts to maintain the voter list is unsubstantiated because there is proof that Defendant Snipes did use information that satisfies maintenance requirements. 

On October 26, 2016, the Court granted Defendant Snipes's second motion to dismiss Count II from August 18, 2016 as to Plaintiff Bellitto's claims but not ACRU's claims. The Court found that Plaintiff failed to provide proper notice to Defendant Snipes regarding a potential violation of the NVRA. The Court denied Defendant UHWE's motion to dismiss for failure to state a claim from September 21, 2016. The Court found that while there is proof Defendant Snipes used information that satisfies voter list maintenance requirements, the Plaintiff is arguing that Defendant Snipes acted inadequately in removing names of voters. As such, there are more plausible inferences that must be evaluated. 

On March 16, 2017, Plaintiff ACRU filed a partial motion for summary judgment on Count II of the first Amended Complaint, arguing that Defendant Snipes had failed to provide access to all maintenance records. On May 26, 2017, Defendants Snipes and UHWE filed a motion for summary judgment on Count I of the Amended Complaint, arguing that a safe harbor provision in the NVRA applies to Defendants and that Defendant Snipes took steps beyond those imposed by the NVRA to maintain voter lists. Also on May 26, 2017, Defendant Snipes filed a motion for summary judgment on Count II of the amended Complaint, arguing that Plaintiff did not make a good faith attempt to inspect the documents after Defendant Snipes directed Plaintiff to do so via Defendant's counsel. 

On July 12, 2017, the Court denied all three motions. The Court denied the ACRU motion because Defendant Snipes argued that she did comply with the requests and made the records available for inspection. As such, the Court found that there was a genuine dispute of material fact and thus could not grant summary judgment on ACRU's claim. The Court denied the Snipes/UHWE Motion because the safe harbor provision applies when there is reasonable voter list maintenance and there is still dispute as to whether Defendant Snipes conducted voter list maintenance with reasonable effort. The Court denied the Snipes motion because the Plaintiff and Defendant Snipes still had differing interpretations as to whether Defendant Snipes did in fact make the documents available to Plaintiff for inspection. As such, the Court found that there was still a genuine dispute of material fact. 

The case proceeded to a five day bench trial and on March 20, 2018, the Court issued a final judgment finding in favor of Defendants. The Court found that Defendant Snipes implemented a program that made a reasonable effort to remove the names of ineligible voters from the voter list.

On April 29, 2018, Plaintiff filed an appeal with the United States Court of Appeals for the Eleventh Circuit (Case No. 18-11808). On August 22, 2019, the Court affirmed the prior Court's decision.
