This case relates to election administration. This case relates to election administration.

Prior to the suit, an individual ran to be a delegate candidate for a private constitutional convention for Native Hawaiians that was run by the Na’i Aupuni Foundation. The Na’i Aupuni Foundation denied his candidacy because the candidate had filed his registration late. 

The plaintiff filed suit on October 27, 2015 in the U.S. District Court in Hawaii, presided over by District Judge John Michael Seabright and subsequently assigned to District Judge Richard L. Puglisi. The plaintiff brought suit against Na'i Apuni Foundation and various officers of the foundation. The plaintiff alleged that there was a conspiracy under 42 U.S.C. § 1985 (3) that violated the right to equal protection under the Fourteenth Amendment, the right to free speech under the First Amendment, the right of due process under the Fifth Amendment and the right to vote under the Fifteenth Amendment of the United States Constitution, and the Voting Rights Act of 1965.

The plaintiff also filed several motions for temporary restraining orders seeking interim relief to be seated as a delegate candidate and to restrain the convention. These were denied on October 29, 2015, February 2, 2016 and February 24, 2016.

In August 2016, the court concluded that the Na’i Aupuni Foundation was not a state actor and that the constitutional convention was a private affair. As such, the plaintiff had no rights under the First, Fifth or Fourteenth Amendments of the United States Constitution (due process or equal protection) as these have not been expressly declared to be enforceable against private impairment, namely impairment without state action. In addition, the court concluded that a private election would not be subject to the Fifteenth Amendment of the United States Constitution, or the Voting Rights Act 1965.

The case was dismissed with prejudice on Aug 1, 2016.
