This is a case alleging that a Maryland county Republican Committee committed financial and election related crimes.
On March 26, 2015, plaintiff, an individual suing on behalf of the Montgomery County Maryland Republican Central Committee (“MCRCC”) sued the defendants, various newly elected members of the MCRCC, arguing criminal and financial wrongdoing and abuse of position by public officials. Plaintiff sought an emergency, ex parte order from the court that would: (1) invalidate MCRCC’s November 11, 2014 election results; (2) require the Maryland State Republican Central Committee to conduct a financial audit of MCRCC’s records; (3) prohibit the Defendants from having access to any MCRCC assets; (4) suspend financial decisions and appointments made by any MCRCC member elected at the November 11, 2014 election; and (5) transfer MCRCC assets to the Maryland State Republican Central Committee. This case was filed in the District of Maryland.
On March 31, 2015, the court dismissed the complaint. The court found that plaintiff (1) failed to satisfy the necessary requirements for a temporary restraining order, including proof that the case was likely to succeed on the merits; (2) the complaint did not comply with federal pleading requirements; (3) the complaint was too broad, confusing, and failed to state any plausible grounds for relief; and (4) there was little evidence of irreparable harm in the absence of emergency relief.
The case is now closed.
