This is a case about the propriety of a school district’s policy limiting parental access to information about whether their children identify as transgender or gender non-conforming. On October 20, 2020, two parents with children in the Montgomery County Public School system pseudonymously filed this lawsuit in the Circuit Court for Montgomery County, Maryland against the Montgomery County Board of Education (MCBE). The parents claimed that MCBE’s “Guidelines for Student Gender Identity” impermissibly circumvent parental involvement in decisions impacting their children’s care, health, education, and futures.  The guidelines allow for the creation of Gender Support Plans for students and include guidance permitting the withholding of student records relating to gender identity from parents as well as guidance restricting disclosure of student gender identity information from parents absent the student’s consent. The parents asserted seven causes of action based on violations of both state and federal law, including a violation of parents’ fundamental rights under the Fourteenth Amendment to “direct the care, custody, education, and control of their minor children.” They sought injunctive, declaratory, and monetary relief under 42 U.S.C. § 1983. 

On December 7, 2020, the case was removed to the United States District Court for the District of Maryland, before Judge Paul W. Grimm; the removal was based on both federal question and supplemental jurisdiction. Shortly after removal, on February 5, 2021, MCBE filed a motion to dismiss the case. On August 18, 2022 the district court granted the motion for dismiss in full, finding that the parents had not alleged sufficient facts demonstrating their rights had been violated. 622 F. Supp. 3d 118. On September 16, 2022, the parents appealed to the U.S. Court of Appeals for the Fourth Circuit (No. 22-2034); the parents only appealed the district court’s decision to dismiss their Fourteenth Amendment claim. 

On August 14, 2023, the Fourth Circuit vacated and remanded the district court’s decision with instructions to dismiss the case for lack of standing. The Fourth Circuit reasoned that the parents lacked both a current injury and an impending or substantial risk of future injury. Regarding current injury, the parents did not allege that any of their children had gender support plans, nor had they spoken with school officials about gender issues. Regarding future injury, the parents failed to allege that they suspected their children might soon seek to create a gender support plan; they only based their claims on speculative fears which, the court reasoned, were too abstract to create standing. 78 F.4th 622.

On October 16, 2023, the district court dismissed the case without prejudice in compliance with the Fourth Circuit’s opinion. On December 5, 2023, the plaintiffs petitioned for certiorari with the U.S. Supreme Court (No. 23-601). The case is ongoing.
